<reftype>Deletes reference to:</reftype><reference>705 ILCS 405/1-1</reference><aliasreference></aliasreference><reftype>Adds reference to:</reftype><reference>705 ILCS 405/5-750</reference><aliasreference></aliasreference><SynopsisText>Replaces everything after the enacting clause. Amends the Juvenile Court Act of 1987. Provides that a delinquent minor shall be committed to the Department of Juvenile Justice when it is the least restrictive alternative based on evidence that efforts were made to locate less restrictive alternatives to secure confinement and the reasons why efforts were unsuccessful in locating a less restrictive alternative to secure confinement. Provides that when a minor of the age of at least 13 years is adjudged delinquent for an offense classified as a misdemeanor or a non-violent felony, there is a presumption in favor of community based treatment rather than secure confinement. Provides that the order of the court shall require the preparation and filing with the court of an individualized case plan, which shall include documentation of less restrictive alternatives to secure confinement and shall include an individualized reentry plan to return the minor to his or her home as soon as possible with supportive services to ensure his or her successful reentry.</SynopsisText><synopsistitle>House Floor Amendment No. 5</synopsistitle>
<SynopsisText>Replaces everything after the enacting clause. Amends the Juvenile Court Act of 1987. Provides that the court may not commit a minor to the Department of Juvenile Justice unless it finds that commitment to the Department of Juvenile Justice is the least restrictive alternative based on evidence that efforts were made to locate less restrictive alternatives to secure confinement and the reasons why efforts were unsuccessful in locating a less restrictive alternative to secure confinement. Provides that before the court commits a minor to the Department of Juvenile Justice, it shall make a finding that secure confinement is necessary, following a review of specified individualized factors. Provides that before the court commits a minor to the Department of Juvenile Justice, the court must find reasonable efforts have been made to prevent or eliminate the need for the minor to be removed from the home, or reasonable efforts cannot, at this time, for good cause, prevent or eliminate the need for removal, and removal from home is in the best interests of the minor, the minor's family, and the public.</SynopsisText></synopsis>
