| AMENDMENT NO. ______. Amend House Bill 1306, AS AMENDED, by |

| replacing everything after the enacting clause with the |
| 4 |
| following:
|

| "Section 5. The Video Gaming
Act is amended by changing |
| 6 |
| Sections 27 and 70 as follows: |
| 7 |
| (230 ILCS 40/27) |
| 8 |
| Sec. 27. Prohibition of video gaming by political |
| 9 |
| subdivision. A
municipality may
pass an ordinance prohibiting |
| 10 |
| video gaming within the corporate limits of the
municipality, |
| 11 |
| except that each existing licensed establishment, licensed |
| 12 |
| fraternal establishment, licensed veterans establishment, or |
| 13 |
| licensed truck stop establishment covered by the ordinance may |
| 14 |
| continue to conduct video gaming for up to 2 years after the |
| 15 |
| date of the approval of the ordinance.
A county board may, for |
| 16 |
| the unincorporated area of the county, pass an
ordinance |

| prohibiting video gaming within the unincorporated area of the
|
| 2 |
| county, except that each existing licensed establishment, |
| 3 |
| licensed fraternal establishment, licensed veterans |
| 4 |
| establishment, or licensed truck stop establishment covered by |
| 5 |
| the ordinance may continue to conduct video gaming for up to 2 |
| 6 |
| years after the date of the approval of the ordinance. |

| Sec. 70. Referendum. Upon the filing in the office of the |
| 10 |
| clerk, at least
90 days
before an election in any municipality |
| 11 |
| or county, as the case
may be, of a petition directed to such |
| 12 |
| clerk, containing the signatures
of not less than 25% of the |
| 13 |
| legal voters of that municipality or county,
the
clerk shall |
| 14 |
| certify such proposition to the proper election officials, who
|
| 15 |
| shall submit the proposition at such election to the voters of |
| 16 |
| such
municipality or county. The proposition shall be in the |
| 17 |
| following form: |
| 18 |

| Shall video gaming YES
|
| 20 |
| be prohibited in ----------------------
|
| 21 |
| .................? NO
|
| 22 |

| 23 |
| If a
majority of the voters voting upon such last mentioned |

| proposition in any
municipality or county vote "YES", such |
| 25 |
| video gaming shall
be prohibited in such municipality or |

| county, except that each existing licensed establishment, |

| 2 years after the date of the approval of the proposition.
The

| petition mentioned in this Section shall be a public document |
| 7 |
| and shall be
subject to inspection by the public. |

| Section 99. Effective date. This Act takes effect upon |
| 10 |
| becoming law.".
