With respect to one of the exceptions to a school district's debt limitation, allows additional indebtedness by the execution of a lease with a public building commission; makes related changes. Removes references that limit provisions to just the Chicago school district with respect to (i) the prohibition on the State Board of Education and the Capital Development Board establishing standards that disapprove or otherwise establishing limitations that restrict the eligibility of a school district for a school construction project grant based on certain facts (including based on the fact that all or a part of the school construction project is owned by a public building commission and leased to the school) and (ii) the authority of a school district to use school construction project grants for certain purposes. Effective immediately.Senate Committee Amendment No. 1 Deletes reference to:105 ILCS 5/17-2.11Replaces everything after the enacting clause. Amends the School Code. In provisions concerning debt limitations of school districts, provides that the execution of leases on or after January 1, 2007 by the Board of Education of Peoria School District 150 with a public building commission for leases entered into pursuant to the Public Building Commission Act shall not be considered indebtedness for purposes of any statutory debt limitation. Amends the School Construction Law. Prohibits the State Board of Education and the Capital Development Board from establishing standards that disapprove or otherwise establishing limitations that restrict the eligibility of a school district that (1) was organized prior to 1860 and (2) is located in part in a city originally incorporated prior to 1840, based on the fact that all or a part of the school construction project is owned by a public building commission and leased to the school district or the fact that any or all of the school construction project grant will be used to pay debt service or to make lease payments. Provides that such a school district is authorized to use any or all of the school construction project grants (i) to pay debt service on bonds that are issued to finance one or more school construction projects and (ii) to the extent that any such bond is a lease or other installment or financing contract between the school district and a public building commission that has issued bonds to finance one or more qualifying school construction projects, to make lease payments under the lease. Effective immediately.House Committee Amendment No. 1 Provides that provisions exempting execution of certain leases by the Board of Education of Peoria School District 150 from being considered indebtedness for purposes of any statutory debt limitation apply only if the State Board of Education or the Capital Development Board makes one or more grants to Peoria School District 150 pursuant to the School Construction Law.
