<reference>New Act</reference><aliasreference></aliasreference><reference>730 ILCS 5/5-5-3</reference><aliasreference>from Ch. 38, par. 1005-5-3</aliasreference><SynopsisText>     Creates the Emergency Services Response Reimbursement for Criminal Convictions Act. Provides that a person convicted of arson, aggravated arson, residential arson, or place of worship arson, in addition to any other sentence imposed, shall be ordered by the court to reimburse the local emergency response department for the costs of responding to the fire that the offender was convicted of setting. Provides that each emergency response department responding to the fire described shall be eligible for reimbursement. Provides that reimbursement shall be based upon the actual cost to the department of the resources used, including but not limited to personnel and equipment, but shall be deemed to be not less than $1,000 nor more than $10,000 per department. Amends the Unified Code of Corrections to make conforming changes. Effective immediately.</SynopsisText><synopsistitle>House Floor Amendment No. 1</synopsistitle>

Reinserts the provisions of the bill. In the Emergency Services Response Reimbursement for Criminal Convictions Act, includes in the definition of "emergency response", a response by a member of a recognized not-for-profit rescue or emergency medical service provider. Provides that the Office of the State Fire Marshal that responds to an emergency shall be eligible for reimbursement. Provides that when actual costs cannot be determined, the reimbursement shall be based on personnel and equipment costs as specified in the Fire Protection District Act. Further amends the Unified Code of Corrections. Provides that the additional arson fines shall be deposited into the Fire Service and Small Equipment Fund (rather than the Fire Prevention Fund). Provides that the additional fines shall be distributed by the Office of the State Fire Marshal as appropriated and according to the rules set forth and adopted under the Emergency Services Response Reimbursement for Criminal Convictions Act.
