| AN ACT concerning children.
|

| Be it enacted by the People of the State of Illinois,
|
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Abused and Neglected Child Reporting Act is |
| 5 |
| amended by adding Section 4.4 as follows: |
| 6 |
| (325 ILCS 5/4.4 new) |
| 7 |
| Sec. 4.4. DCFS duty to report to State's Attorney. Whenever |
| 8 |
| the Department receives, by means of its statewide toll-free |
| 9 |
| telephone number established under Section 7.6 for the purpose |
| 10 |
| of reporting suspected child abuse or neglect or by any other |
| 11 |
| means or from any mandated reporter under Section 4, a report |
| 12 |
| of a newborn infant whose blood, urine, or meconium contains |
| 13 |
| any amount of a controlled substance as defined in subsection |
| 14 |
| (f) of Section 102 of the Illinois Controlled Substances Act or |
| 15 |
| a metabolite thereof,
with the exception of a controlled |
| 16 |
| substance or metabolite thereof whose
presence in the newborn |
| 17 |
| infant is the result of medical treatment administered
to the |
| 18 |
| mother or the newborn infant, the Department must immediately |
| 19 |
| report that information to the State's Attorney of the county |
| 20 |
| in which the infant was born.

| 21 |
| Section 99. Effective date. This Act takes effect upon |
| 22 |
| becoming law.
