| 1 | AN ACT concerning education.

| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||
| 4 | Section 5. The School Code is amended by changing Section | |||||||||||||||||||
| 5 | 26-3a as follows:
| |||||||||||||||||||

| 8 | Sec. 26-3a. Report of pupils no longer enrolled in school.
| |||||||||||||||||||
| 9 | The clerk or secretary of the school board of all school | |||||||||||||||||||
| 10 | districts shall
furnish quarterly on the first school day of | |||||||||||||||||||
| 11 | October, January, April and
July to the regional superintendent | |||||||||||||||||||
| 12 | a list of pupils, excluding
transferees, who have been expelled | |||||||||||||||||||
| 13 | or have withdrawn or who have left
school and have been removed | |||||||||||||||||||
| 14 | from the regular attendance rolls during the
period of time | |||||||||||||||||||
| 15 | school was in regular session from the time of the previous
| |||||||||||||||||||
| 16 | quarterly report. Such list shall include the names and | |||||||||||||||||||
| 17 | addresses of pupils
formerly in attendance, the names and | |||||||||||||||||||
| 18 | addresses of persons having custody
or control of such pupils, | |||||||||||||||||||
| 19 | the reason, if known, such pupils are no longer
in attendance | |||||||||||||||||||
| 20 | and the date of removal from the attendance rolls. The
regional | |||||||||||||||||||
| 21 | superintendent shall inform the county or district truant | |||||||||||||||||||
| 22 | officer
who shall investigate to see that such pupils are in | |||||||||||||||||||
| 23 | compliance with the
requirements of this Article.

| 1 | In addition, the regional superintendent of schools of each | ||||||
| 2 | educational
service region shall report to the State Board of | ||||||
| 3 | Education, in January of
1992 and in January of each year | ||||||
| 4 | thereafter, the number and ages of
dropouts, as defined in | ||||||
| 5 | Section 26-2a, in his educational service region
during the | ||||||
| 6 | school year that ended in the immediately preceding calendar
| ||||||
| 7 | year, together with any efforts, activities and programs | ||||||
| 8 | undertaken,
established, implemented or coordinated by the | ||||||
| 9 | regional superintendent of
schools that have been effective in | ||||||
| 10 | inducing dropouts to re-enroll in school.

or control of such pupils, the reason, if known, | ||||||
| 25 | such pupils are no longer

| 1 | from the attendance rolls. This list may include the names of | ||||||
| 2 | pupils who have been adjudicated as truant by the school | ||||||
| 3 | district.
The list shall also include the names of: pupils | ||||||
| 4 | whose withdrawal is due to extraordinary circumstances, | ||||||
| 5 | including but not limited to economic or medical necessity or | ||||||
| 6 | family hardship, as determined by the criteria established by | ||||||
| 7 | the school district; pupils who have re-enrolled in school | ||||||
| 8 | since their names were removed from the attendance rolls; any | ||||||
| 9 | pupil certified to be a chronic or habitual truant, as defined | ||||||
| 10 | in Section 26-2a; and pupils previously certified as chronic or | ||||||
| 11 | habitual truants who have resumed regular school attendance.
| ||||||
| 12 | The
regional superintendent shall inform the county or district | ||||||
| 13 | truant officer
who shall investigate to see that such pupils | ||||||
| 14 | are in compliance with the
requirements of this Article.
| ||||||
| 15 | Each local school district shall establish, in writing, a | ||||||
| 16 | set of criteria for use by the local superintendent of schools | ||||||
| 17 | in determining whether a pupil's failure to attend school is | ||||||
| 18 | the result of extraordinary circumstances, including but not | ||||||
| 19 | limited to economic or medical necessity or family hardship. | ||||||
| 20 | If a pupil re-enrolls in school after his or her name was | ||||||
| 21 | removed from the attendance rolls or resumes regular attendance | ||||||
| 22 | after being certified a chronic or habitual truant, the pupil | ||||||
| 23 | must obtain and forward to the Secretary of State, on a form | ||||||
| 24 | designated by the Secretary of State, verification of his or | ||||||
| 25 | her re-enrollment. The verification may be in the form of a | ||||||
| 26 | signature or seal or in any other form determined by the school | ||||||
| |||||||
| |||||||
| 1 | board.
| ||||||
| 2 | In addition, the regional superintendent of schools of each | ||||||
| 3 | educational
service region shall report to the State Board of | ||||||
| 4 | Education, in January of
1992 and in January of each year | ||||||

| 13 | upon request, a comparison of drop out rates before and after | ||||||
| 14 | the effective date of this amendatory Act of the 94th General | ||||||
| 15 | Assembly.

| 17 | Section 95. No acceleration or delay. Where this Act makes | ||||||
| 18 | changes in a statute that is represented in this Act by text | ||||||
| 19 | that is not yet or no longer in effect (for example, a Section | ||||||
| 20 | represented by multiple versions), the use of that text does | ||||||
| 21 | not accelerate or delay the taking effect of (i) the changes | ||||||
| 22 | made by this Act or (ii) provisions derived from any other | ||||||
| 23 | Public Act.
