| AMENDMENT NO. ______. Amend House Bill 1297 by replacing |

| everything after the enacting clause with the following:

| "Section 1. Short title. This Act may be cited as the Trans |
| 5 |
| Fat Disclosure Act.
|
| 6 |
| Section 5. Trans fat disclosure. A restaurant or similar |
| 7 |
| retail food establishment must mark any food containing trans |
| 8 |
| fat with a label on its menu stating that the food contains |
| 9 |
| trans fat. This Section applies only to restaurants and similar |
| 10 |
| retail food establishments with $20 million or more in annual |
| 11 |
| gross sales.

| 12 |
| Section 10. Administration; enforcement. The Department of |
| 13 |
| Public Health shall adopt rules to administer and enforce this |
| 14 |
| Act, including the imposition of a civil penalty.".
