| AMENDMENT NO. ______. Amend House Bill 38 as follows:

| on page 1, immediately below line 23, by inserting the |

| following:

| "(a-5) For purposes of this Section, gross disobedience and |
| 6 |
| gross misconduct may include communications by electronic |
| 7 |
| means, including communication by use of an Internet website, |
| 8 |
| made by the pupil with the intent to harm, threaten, harass, |
| 9 |
| intimidate, humiliate, or bully another student, a school |
| 10 |
| administrator, a faculty member, other school-related |
| 11 |
| personnel, or another person or persons connected to the school |
| 12 |
| community if the communication is disruptive to the educational |
| 13 |
| process. Intent may be inferred from the nature, means, |
| 14 |
| content, and context of the communication.".
