<reference>775 ILCS 5/5-101</reference><aliasreference>from Ch. 68, par. 5-101</aliasreference><SynopsisText>Amends provisions of the Illinois Human Rights Act defining "place of public accommodation" to include a non-sectarian nursery, day care center, elementary, secondary, undergraduate, or postgraduate school, or other place of education in regard to the failure to enroll an individual or the denial of access to its facilities, goods, or services. Deletes language that provided that the Department of Human Rights shall not have jurisdiction over charges involving conduct of the class by the teacher or instructor or any activity within the classroom or connected with a class activity such as physical education. Effective immediately.</SynopsisText><synopsistitle>Senate Floor Amendment No. 1</synopsistitle>
<reftype>Adds reference to:</reftype><reference>775 ILCS 5/5-102.2 new</reference><aliasreference></aliasreference><SynopsisText>Replaces everything after the enacting clause. In provisions of the Illinois Human Rights Act defining "place of public accommodation" to include a non-sectarian nursery, day care center, elementary, secondary, undergraduate, or postgraduate school, or other place of education, deletes from the definition language setting forth grounds for a charge and limiting the jurisdiction of the Department of Human Rights. Adds a Section providing that, in regard to a non-sectarian nursery, day care center, elementary, secondary, undergraduate, or postgraduate school, or other place of education, the jurisdiction of the Department of Human Rights is limited to: (1) the failure to enroll an individual; (2) the denial of access to facilities, goods, or services; (3) harassment, bullying, or similar acts against an individual; or (4) the failure of a covered entity to take corrective action to stop harassment, bullying, or other acts against an individual. <reftype>Adds reference to:</reftype><reference>775 ILCS 5/5-102.1</reference><aliasreference></aliasreference><SynopsisText>Replaces everything after the enacting clause with substantially similar provisions and it further amends the Illinois Human Rights Act by providing that: (1) neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion; and (2) with respect to a non-sectarian nursery, day care center, school, or other place of education that is a place of public accommodation, as defined in the Act, the exercise of free speech, free expression, free exercise of religion or expression of religiously based views by any individual or group of individuals that is protected under the First Amendment to the United States Constitution or under Article I of the Illinois Constitution, shall not be a civil rights violation.
