Makes a technical change in a Section concerning legislative intent.Senate Floor Amendment No. 1 Deletes reference to:410 ILCS 513/5Adds reference to:430 ILCS 65/3.1from Ch. 38, par. 83-3.1740 ILCS 110/12from Ch. 91 1/2, par. 812Replaces everything after the enacting clause. Amends the Firearm Owners Identification Card Act. Provides that the Department of State Police and the Department of Human Services shall, in accordance with State and federal law regarding confidentiality, enter into a memorandum of understanding with the Federal Bureau of Investigation for the purpose of implementing the National Instant Criminal Background Check System in the State. Provides that the Department of State Police shall report the name, date of birth, and physical description of any person prohibited from possessing a firearm pursuant to the Firearm Owners Identification Card Act and certain provisions of the federal Gun Control Act to the National Instant Criminal Background Check System Index, Denied Persons Files. Amends the Mental Health and Developmental Disabilities Confidentiality Act. Provides that public hospitals and mental health facilities shall furnish to the Department of State Police such information as may be required for the sole purpose of determining whether an individual is disqualified from receiving or retaining a Firearm Owner's Identification Card. Defines "mental health facility".House Amendment No. 1 Makes technical and grammatical changes. In the amendatory changes to the Mental Health and Developmental Disabilities Confidentiality Act, provides that mental health records may be redisclosed for checking with the National Instant Criminal Background Check System Index to determine if a person is prohibited from obtaining a firearm under federal or State law. Provides that the definition of mental health facility is as defined in the Mental Health and Developmental Disabilities Code. Changes definition of "patient".Fiscal Note, House Amendment No. 1 (Dept. of Human Services) SB 940 (H-AM 1) has no fiscal impact to the Department of Human Services.Fiscal Note, House Amendment No. 1 (Dept. of Transportation) Passage of this legislation will cause no fiscal impact to the Illinois Department of Transportation. Judicial Note, House Amendment No. 1 (Admin Office of the Illinois Courts) This legislation would neither increase nor decrease the number of judges needed in the judicial branch.Fiscal Note, House Amendment No. 1 (Illinois State Police) If SB 940 (H-AM 1) were to become law, the fiscal impact to the Illinois State Police would be approximately $100,000.Land Conveyance Appraisal Note, House Amendment No. 1 (Dept. of Transportation) No land conveyances are included in SB 940 (H-AM 1), therefore, there are no appraisals to be filed. Home Rule Note, House Amendment No. 1 (Dept. of Commerce & Economic Opportunity) This legislation does not pre-empt home rule authority. Pension Note, House Amendment No. 1 (Government Forecasting & Accountability) SB 940 (H-AM 1) will not impact any public pension fund or retirement system in Illinois. State Debt Impact Note, House Amendment No. 1 (Government Forecasting & Accountability) SB 940 (H-AM 1) will not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness. State Mandates Fiscal Note, House Amendment No. 1 (Dept. of Commerce & Economic Opportunity) It is the opinion of the Department of Commerce and Economic Opportunity, SB 940 (H-AM 1) creates a service mandate.Housing Affordability Impact Note, House Amendment No. 1 (Housing Development Authority) This legislation will have no effect on constructing, purchasing, owning, or selling a single-family residence.
