<reference>720 ILCS 5/16-8</reference><aliasreference>from Ch. 38, par. 16-8</aliasreference><SynopsisText>Amends the Criminal Code of 1961 relating to the offense of the unlawful use of unidentified sound or audio visual recordings. Defines "manufacture" for purposes of the offense. Provides that when the offense involves more than 100 unidentified sound recordings or more than 7 unidentified audio visual recordings during any 180 day period, the trier of fact may infer (but is not required to infer) the existence of any of the mental states set forth for the offense. Effective immediately.</SynopsisText><synopsistitle>Senate Committee Amendment No. 1</synopsistitle>

Amends the Criminal Code of 1961 relating to the offenses of unlawful use of recorded sounds or images and unlawful use of unidentified sound or audio visual recordings. Provides that the definition of manufacturer of recorded sounds or images does not include a person who manufactures a medium upon which sounds or visual images can be recorded or stored, or who manufactures the cartridge or casing itself. Provides that the offense of unlawful use of unidentified sound or audio visual recordings includes advertisement, offer for sale, transportation, or possession for manufacture, sale, distribution, vending, circulation, performance, lease, advertisement, offer for sale, or transportation. Provides that upon conviction of the offense of unlawful use of unidentified sound or audio visual recordings, the offender shall be sentenced to make restitution to any owner or lawful producer of a master sound or audio visual recording, or to the trade association representing such owner or lawful producer, that has suffered injury resulting from the crime. Provides that the order of restitution shall be based on the aggregate wholesale value of lawfully manufactured and authorized sound or audio visual recordings corresponding to the non-conforming recorded devices involved in the offense, and shall include investigative costs relating to the offense.</SynopsisText><synopsistitle>House Amendment No. 1</synopsistitle>
<SynopsisText>Provides that for the purposes of the offenses of unlawful use of recorded sounds or images and the unlawful use of unidentified sound or audio visual recordings, the term "manufacturer" does not include a person who manufactures the (rather than a) medium upon which sounds or visual images can be recorded or stored.</SynopsisText></synopsis>
