<reference>410 ILCS 45/9.5 new</reference><aliasreference></aliasreference><reference>410 ILCS 45/11.05</reference><aliasreference></aliasreference><SynopsisText>     Amends the Lead Poisoning Prevention Act. Provides that the Department of Public Health shall create, maintain, and make available to the public a Hazardous Housing Registry that will provide information regarding all properties within the State for which a mitigation notice has been issued pursuant to this Act. Provides that the property shall remain on the registry until the Department issues a certificate of compliance. Sets forth the specific requirements for information that shall be made available for properties included on the registry. Provides that the Department shall make the Hazardous Housing Registry available on its Internet website, accessible through a link on the Department's home page or first entry point. Provides that the Department shall include the required information for all housing for which a mitigation notice was issued prior to the effective date of the Act. Provides that the Lead-Safe Housing Advisory Council shall develop a distribution plan for the Hazardous Housing Registry created pursuant to the Act and that the Department shall implement the distribution plan before January 1, 2009. <SynopsisText>Provides that there is no rulemaking authority under the amendatory Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.</SynopsisText><synopsistitle>Fiscal Note, House Amendment No. 1 (Dept. of Public Health)</synopsistitle>
<SynopsisText>The Illinois Department of Public Health estimates the fiscal impact of HB 5790 for database design and maintenance and staff resources to update and maintain the database at $125,000 annually. HB 5790 (H-AM 1) would not increase this total.</SynopsisText><synopsistitle>Housing Affordability Impact Note, House Amendment No. 1 (Housing Development Authority)</synopsistitle>
<SynopsisText>This legislation will have no effect on constructing, purchasing, owning, or selling a single-family residence.</SynopsisText><synopsistitle>House Amendment No. 2</synopsistitle>
<SynopsisText>Provides that the Department of Public Health shall create, maintain, and make available to the public a Lead-Hazardous Housing Registry that will provide information regarding properties within the State that have been determined to contain a lead hazard (rather than for which a mitigation notice has been issued) pursuant to specified provisions. Adds provisions concerning the listing of a property on the registry. Removes a provision requiring that the dates of any deadline extensions issued by the Department or its delegate agencies pursuant to specified provisions be made available for properties included on the registry. Removes provisions concerning the addition and removal of properties from the registry. Adds language to provide that properties shall be removed from the Lead-Hazardous Registry within 3 business days after the Department or delegate agency issues a certificate of compliance. Adds language to require that delegate agencies shall inform the Department within 3 business days that the certificate of compliance has been issued. Adds language to provide that the Department shall make the Lead-Hazardous Housing registry available on its Internet website within 90 days after the effective date of the amendatory Act. Adds language to provide that the Department shall include the required information for all properties (rather than all housing) for which a mitigation was issued more than 180 days prior (rather than not specifying a number of days) to the effective date of the amendatory Act.
