Provides that an application for State employment may not contain any question as to whether the applicant was convicted of or placed on supervision for a non-violent criminal offense but must contain a question as to whether the applicant for State employment has ever been convicted of a violent offense that is classified as a felony. Requires each applicant for State employment to undergo a criminal background check. Provides that if a federal or State law disqualifies a person convicted of certain offenses from holding a position, an application for that position may inquire as to whether the applicant has been convicted of a disqualifying offense. Provides that if an applicant is applying for a position of peace officer, an application for that position may inquire as to whether the applicant has been convicted of a disqualifying offense. Provides that nothing in the Act prohibits a decision to refuse to hire on the basis that the applicant has been convicted of a criminal offense. Effective immediately.House Amendment No. 1 Excludes from the definition of State agency, the General Assembly, any officer of the General Assembly, or any legislative support service agency of the General Assembly. Provides that only applicants who are interviewed for State employment must undergo criminal background checks. Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.Fiscal Note, House Amendment No. 1 (Illinois State Police) No fiscal impact to the Illinois State Police. Fiscal Note, House Amendment No. 1 (Dept. of Central Management Services) HB 4612 (H-AM 1) has the potential to have a significant statewide administrative impact. The estimated fiscal impact on CMS is approximately $15,000 for the re-printing of CMS application forms and for administrative operations and system enhancements. This estimate assumes that the fees charged by the Illinois State Police will be paid by the applicant. House Amendment No. 3 Deletes new provision that a veteran who has served during Operation Enduring Freedom or Operation Iraqi Freedom in a combat area covered by those hostilities shall receive a preference of 2 additional points on the civil service entrance exam under certain conditions. Provides that a veteran who has served during a time of hostilities with a foreign country is qualified for a preference of 7 (rather than 5) points under certain conditions.House Amendment No. 4 Adds reference to:20 ILCS 415/8b.7from Ch. 127, par. 63b108b.7Replaces everything after the enacting clause. Creates the State Employment Application Act. Further amends the Personnel Code. Provides that a veteran with a service connected disability is qualified for a preference on the entrance exam of 12 (rather than 10) points. Provides that a person who has served in the armed forces of the United States, the Illinois National Guard, or any reserve component of the armed forces of the United States not in times of hostilities with a foreign country is qualified for a 5 point preference on the entrance exam (rather than a 3 point preference).
