Colvin, Harry Osterman and Kathleen A. Ryg 1/13/2009HouseSession Sine Die New Act Creates the Handgun Dealer Licensing Act. Provides for the regulation of handgun dealers through licensure by the Department of State Police. Provides that no person may sell or otherwise transfer, expose for sale or transfer, or have in his or her possession with the intent to sell or transfer any concealable firearm without being licensed under the Act. Provides, however, that the prohibition does not apply to a person who makes occasional sales, exchanges, or purchases of concealable firearms for the enhancement of a personal collection or as a hobby, or who sells all or part of his or her personal collection of firearms. Sets forth provisions concerning application, fees, duration of licensure, license retention requirements, submissions to the Department, penalties, revocation, and suspension. Grants rulemaking authority to the Department and provides that for the purpose of determining compliance with the Act, the Act may be enforced by any municipality in which a licensee is located or, if a licensee is not located in a municipality, by the county in which a licensee is located.Fiscal Note (Illinois State Police) If HB 796 were to become law, the fiscal impact to the Illinois State Police would be approximately $1 million. A system would need to be developed to track handgun firearm licenses, and a separate system developed to register handgun firearms. Staff would need to be identified to manage, administer and enforce both programs. The costs of this would be offset by some degree by the $300 fee attached to each application for license; however, system development costs could be as high as $650,000. A staff increase of six at a cost of approximately $300,000 would be needed to handle license eligibility, document review, inspection and enforcement issues, and firearm registration. The program would require at least two automobiles for licensee inspectors to use. Computer hardware would cost approximately $25,000.House Amendment No. 1 Provides that neither the Governor nor any agency or agency head under the jurisdiction of the Governor has any rulemaking authority under the Act, but that the Governor may suggest rules by filing them with the General Assembly and requesting that the General Assembly authorize such rulemaking by law, enact the suggested rules into law, or take other appropriate action in the General Assembly's discretion.
