AMENDMENT TO SENATE BILL 3018

    AMENDMENT NO. ______. Amend Senate Bill 3018 on page 3, by 
3
replacing lines 21 through 26 with the following:
4
            "(i) a person who suffers from a permanent physical 
5
        impairment resulting from disease, injury, functional 
6
        disorder, or congenital condition that renders the 
7
        individual incapable of giving informed consent to 
8
        sexual conduct or sexual penetration;

9
            (ii) a person who suffers from a permanent mental 
10
        impairment resulting from disease, injury, functional 
11
        disorder, or congenital condition that impairs the 
12
        individual's mental ability to independently manage 
13
        his or her property or financial resources, or both;
14
            (iii) a person who suffers from a permanent 
15
        physical disability resulting from disease, injury, 
16
        functional disorder, or congenital condition that 
17
        impairs the individual's mental or physical ability 
18
        and is under the care and custody of the State, or 
19
        resides in a Department of Human Services funded 
20
        Community Integrated Living Arrangement (CILA);"; and

on page 3, line 27, by replacing "(ii)" with "(iv)"; and
 
22
on page 3, line 30, by replacing "(iii)" with "(v)".
