| AN ACT concerning health.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Illinois Clean Indoor Air Act is amended by |
| 5 |
| adding Section 4.5 as follows:
|

| (410 ILCS 80/4.5 new) |
| 7 |
| Sec. 4.5. Smoking prohibited in student dormitories. |
| 8 |
| (a) Notwithstanding any other provision of this Act, |
| 9 |
| smoking is prohibited in any portion of the living quarters, |
| 10 |
| including, but not limited to, sleeping rooms, dining areas, |
| 11 |
| restrooms, laundry areas, lobbies, and hallways, of a building |
| 12 |
| used in whole or in part as a student dormitory that is owned |
| 13 |
| and operated or otherwise utilized by a public or private |
| 14 |
| institution of higher education. |
| 15 |
| (b) This Section does not apply to any commercial area |
| 16 |
| within the building.

| 17 |
| Section 99. Effective date. This Act takes effect upon |
| 18 |
| becoming law.
