| AN ACT concerning fish.
|

| Be it enacted by the People of the State of Illinois, |
| 3 |
| represented in the General Assembly:
|
| 4 |
| Section 5. The Fish and Aquatic Life Code is amended by |
| 5 |
| changing Section 10-100 as follows:
|
| 6 |
| (515 ILCS 5/10-100) (from Ch. 56, par. 10-100)

| Sec. 10-100. Release of aquatic life. It shall be unlawful |
| 8 |
| to
release any aquatic life
into waters of this State without |
| 9 |
| first securing permission of the
the
Department to do so, |
| 10 |
| except that the owner of a body of water may release
aquatic |
| 11 |
| life into waters wholly upon his or her property that are
|
| 12 |
| indigenous to the
State of Illinois. The Department shall have |
| 13 |
| the authority to promulgate
necessary rules and regulations, |
| 14 |
| under the Illinois Administrative
Procedure Act, regulating |
| 15 |
| the possession, transportation, and shipping of
aquatic life |
| 16 |
| not indigenous to the State of Illinois. All aquatic life may |
| 17 |
| be
released into waters from which they were taken. |
