AMENDMENT TO SENATE BILL 951

    AMENDMENT NO. ______. Amend Senate Bill 951 on page 17, 
3
line 9, by replacing "reliable evidence" with "evidence, 
4
received from State or federal law enforcement or federal 
5
oversight agencies or from the results of a preliminary 
6
Department audit and determined by the Department to be 
7
credible,"; and

 
8
on page 17, line 13, after the period, by inserting the 
9
following: "The Department shall by rule define what 
10
constitutes "credible" evidence for purposes of this 
11
subsection."; and
 
12
on page 17, line 15, after the period, by inserting the 
13
following: "A provider or alternate payee may request a 
14
reconsideration of payment withholding, and the Department 
15
must grant such a request. The Department shall state by rule a 
16
process and criteria by which a provider or alternate payee may 
17
request full or partial release of payments withheld under this 
18
subsection. This request may be made at any time after the 
19
Department first withholds such payments."; and
 
20
on page 17, line 32, by replacing "consideration" with 
21
"reconsideration of the withholding"; and
 
22
on page 17, between lines 33 and 34, by inserting the

following:

        "(5) Inform the provider or alternate payee that a

    written request may be made to the Illinois Department for 
4
    full or partial release of withheld payments and that such 
5
    requests may be made at any time after the Department first

    withholds such payments."; and

on page 18, between lines 9 and 10, by inserting the following:

        "(3) The withholding of payments for a period of 3 
9
    years.".
