    AMENDMENT NO. ______. Amend Senate Bill 429 as follows:

on page 24, by replacing line 16 through line 27 with the

following:

    "amendatory Act of 1988, whichever is later. If the balance 
6
    in the Low-Level Radioactive Waste Facility Development 
7
    and
Operation Fund falls below $500,000, as of the end of 
8
    any fiscal year after
fiscal year 2002, the
Department is 
9
    authorized to assess by rule, after notice
and a hearing, 
10
    an additional annual fee to be paid by the owners of 
11
    nuclear
power
reactors for which operating licenses have 
12
    been issued by the Nuclear
Regulatory Commission, except 
13
    that no additional annual fee shall be assessed because of 
14
    the fund balance
at the end of fiscal year 2005 or at the 
15
    end of fiscal year 2006. The additional annual fee shall be 
16
    payable on the date
or dates specified by rule and shall 
17
    not exceed $30,000 per operating reactor
per year.".
