| AN ACT concerning the Township Code.
|

| Be it enacted by the People of the State of Illinois,
|

| represented in the General Assembly:
|

| Section 5. The Township Code is amended by adding Section |
| 5 |
| 115-66 as follows:
|

| (60 ILCS 1/115-66 new) |
| 7 |
| Sec. 115-66. Surplus for maintenance and operation of open |
| 8 |
| spaces. A township that has adopted an open space plan may |
| 9 |
| maintain and receive from year to year funds for maintenance |
| 10 |
| and operation of the township's open spaces in surplus of the |
| 11 |
| amount necessary for the annual maintenance and operation of |
| 12 |
| open spaces within the township. The surplus shall be |
| 13 |
| maintained in a separate fund and not commingled with the |
| 14 |
| township general fund. The surplus shall not be derived from |
| 15 |
| any township tax levy.

| 16 |
| Section 99. Effective date. This Act takes effect upon |
| 17 |
| becoming law.
