Creates the FY2005 Budget Implementation (Human Services) Act for the purpose of making changes in State programs that are necessary to implement the Governor's FY2005 budget recommendations concerning human services. Amends the Illinois Administrative Procedure Act to authorize certain emergency rulemaking. Amends the Mental Health and Developmental Disabilities Administrative Act, the State Finance Act, the Illinois Income Tax Act, the Nursing Home Care Act, the Pharmacy Practice Act of 1987, the Illinois Public Aid Code, the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act, and the Illinois Food, Drug and Cosmetic Act. Provides that beginning in FY05, and thereafter, certain amounts received from the federal government for community mental health services shall be deposited into GRF instead of into the Community Mental Health Medicaid Trust Fund; provides for the deposit of certain federal moneys into the Community Developmental Disability Services Medicaid Trust Fund. Provides that payments may be made by the Department of Children and Family Services for tuition of children from orphanages and children's homes without regard to any fiscal year limitations. Provides for disbursements from the Family Care Fund pursuant to an interagency agreement between the Department of Public Aid and another agency of State government. Provides for transfers to GRF from the Hospital Provider Fund and the Health and Human Services Medicaid Trust Fund, and provides that such transfers may not exceed a total of $80,000,000 in any State fiscal year. Authorizes the Department of Human Services to make medical payments from its appropriations relating to substance abuse treatment services, regardless of whether the medical services were rendered in a prior fiscal year. Provides that the Director of Revenue may exchange information with the Illinois Department on Aging for the purpose of verifying sources and amounts of income for purposes directly related to confirming eligibility for participation in the programs of benefits authorized by the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act. Changes nursing home license fees, providing for a single $995 annual fee and requiring the deposit of all license fees into the Long Term Care Monitor/Receiver Fund; eliminates a provision for the deposit of license fees in excess of $600,000 into GRF. In connection with prescription drugs, removes references to the Technical Advisory Council. Under the Medicaid program, eliminates a provision prohibiting the purchase or lease-purchase of durable medical equipment or supplies used for oxygen delivery and respiratory care. Provides that Medicaid rates for nursing homes taking effect on July 1, 2004 shall be 3% greater than the rates in effect on June 30, 2004 if the federal Centers for Medicare and Medicaid Services approve (i) payment methodologies required under provisions concerning hospital access improvement payments and (ii) a federal waiver granted under federal rules. Provides that Medicaid nursing home rates taking effect on January 1, 2005 shall be 3% more than the rates in effect on December 31, 2004. Requires the Department of Public Aid to approve a nursing home's bed reserves at a daily rate of 75% of an individual's Medicaid per diem under certain conditions. Makes changes concerning Medicaid hospital provider assessments, including provisions concerning the administration and enforcement of the assessments and provisions concerning hospital access improvement payments. Requires that the pharmaceutical assistance program under the Senior Citizens and Disabled Persons Property Tax Relief and Pharmaceutical Assistance Act include provision for automatic enrollment of beneficiaries into a Medicare Discount Card program. Makes other changes. Effective immediately.</SynopsisText></synopsis>
