<reference>720 ILCS 5/9-3</reference><aliasreference>from Ch. 38, par. 9-3</aliasreference><SynopsisText>Amends the Criminal Code of 1961. Eliminates the presumption in reckless homicide cases that being under the influence of alcohol or any other drug or drugs at the time of the alleged violation is evidence of a reckless act unless disproved by evidence to the contrary. Provides that the trier of fact may take into consideration whether or not the defendant's being under the influence was evidence of a reckless act. Effective immediately.</SynopsisText></synopsis>
