Amends the Illinois Income Tax Act. Exempts from filing an Illinois income tax return nonresidents whose Illinois income tax liability is paid in full after taking into account certain credits. For taxable years ending on or after December 31, 2004, (i) allows a credit for certain nonresidents for the amount of tax paid on a composite return on his or her behalf and allows the credit for certain residents but only if permitted by the Department of Revenue by rule; (ii) authorizes the Department to promulgate rules allowing a partnership or Subchapter S corporation which has made an error on its return that affects the Illinois income tax liability of a partner or shareholder to report the changes and claim a refund for any resulting overpayment or pay the resulting underpayment on behalf of the partner or shareholder; (iii) requires partnerships, Subchapter S corporations, and trusts to withhold from nonresident partners, shareholders, and beneficiaries an amount equal to the distributable share of the business income apportionable to Illinois multiplied by the applicable rate of tax and requires that the withholding be treated as a payment of the estimated tax liability or the liability for withholding of the partner, shareholder, or beneficiary.
