<synopsistitle></synopsistitle>
<reference>765 ILCS 740/3 new</reference><aliasreference></aliasreference><SynopsisText>     Amends the Tenant Utility Payment Disclosure Act. Requires a landlord to provide to the prospective tenant a separate statement detailing any utility services to be paid for by the landlord. Provides that failure of the landlord to provide the required statement does not invalidate the lease, but gives rise to a rebuttable presumption of the landlord's bad faith in any action against the landlord based in whole or in part on the landlord's failure to provide utility services.</SynopsisText><synopsistitle>House Amendment No. 1</synopsistitle>
<SynopsisText>Provides that nothing in the Section concerning the disclosure of utility services to be provided by the landlord shall be interpreted as authorizing the resale of electric service.</SynopsisText><synopsistitle>House Amendment No. 2</synopsistitle>
<SynopsisText>Deletes everything after the enacting clause. Reinserts the provisions of the original bill. Changes references from a separate statement detailing any utility services to be paid for by the landlord to a signed and sworn affidavit detailing any utility services to be paid for by the landlord.</SynopsisText><synopsistitle>Senate Floor Amendment No. 1</synopsistitle>

Amends the Rental Property Utility Service Act. Provides that whenever a landlord or his or her agent is required to pay for any water, gas or electrical service, the landlord shall pay for the services to ensure that the services are available to the tenant throughout the term of the lease and shall pay for the services in a timely manner so as not to cause an interruption of the services. Provides that if the landlord or his or her agent does not pay for the services, the tenant or tenants may terminate the lease; however, the termination of the lease does not absolve the landlord or tenant from any obligations that have arisen under the lease prior to its termination.</SynopsisText></synopsis>
