<reference>720 ILCS 5/9-1</reference><aliasreference>from Ch. 38, par. 9-1</aliasreference><SynopsisText>     Amends the Criminal Code of 1961. Provides that before a jury makes a determination with respect to the imposition of the death penalty, the court shall instruct the jury of the applicable alternative sentences that the court may impose for first degree murder if the jury precludes the death sentence. Provides that the jury shall weigh the factors in aggravation and mitigation to decide if death is the appropriate sentence (instead of determining that there are no mitigating factors sufficient to preclude the imposition of the death sentence.) Provides that in cases where there is no jury, the court shall weigh the factors in aggravation and mitigation, to decide if death is the appropriate sentence (instead of determining that there are no mitigating factors sufficient to preclude the imposition of the death sentence.) Provides that if the court does not concur with the jury determination that death is the appropriate sentence, the court shall set forth reasons in writing and shall impose a term of natural life imprisonment.</SynopsisText></synopsis>
