<reference>820 ILCS 305/4</reference><aliasreference>from Ch. 48, par. 138.4</aliasreference><reference>820 ILCS 310/4</reference><aliasreference>from Ch. 48, par. 172.39</aliasreference><SynopsisText>     Amends the Workers' Compensation Act and the Workers' Occupational Diseases Act. Provides that if the Industrial Commission finds by clear and convincing evidence that a workers' compensation insurer has has been shown to engage in a pattern and practice of fraudulent delay or unfairness (rather than finding that the insurer practices a policy of delay or unfairness) toward employees in the adjustment, settlement, or payment of benefits, the Commission may order the insurer to discontinue the writing of workers' compensation insurance in Illinois.</SynopsisText></synopsis>
