Changes the short title of the Sale of Tobacco to Minors Act to the Sale of Tobacco to Underage Persons Act, and changes the full titles of all 3 Acts. Changes references to "minors" to "persons under 19 years of age". Increases from 18 to 19 the age at which a person may lawfully buy cigarettes or other tobacco products, tobacco accessories, or smoking herbs. Effective January 1, 2004.Fiscal Note (Office of the Secretary of State) HB 1383 has no fiscal impact on the Secretary of State's office.House Amendment No. 1 Provides that the prohibitions against selling tobacco, smokeless tobacco, or tobacco accessories or smoking herbs do not apply to persons under 19 years of age who are in active military service with the armed forces of the United States.House Amendment No. 2 Adds reference to:720 ILCS 675/2from Ch. 23, par. 2358720 ILCS 685/5from Ch. 23, par. 2358-5Provides that a person who violates the Sale of Tobacco to Minors Act, the Smokeless Tobacco Limitation Act, or the Tobacco Accessories and Smoking Herbs Control Act on or after January 1, 2004 and before January 1, 2005 by making or causing to be made a prohibited sale or delivery of tobacco or another item to a person 18 years of age shall be issued a warning only and is not guilty of a criminal offense.House Amendment No. 3 Provides that the prohibitions against the sale of tobacco or related products do not apply to a person under age 19 who is age 18 and the holder of a valid United States Military Identification Card (instead of a person under age 19 who is in active military service with the armed forces of the United States).Pension Note (H-AM 3) (Pension Laws Commission) HB 1383, as amended by House Amendment 3, does not amend the Pension Code, it has no fiscal impact on any public pension fund or retirement system in Illinois. State Debt Impact Note (H-AM 3) (Economic and Fiscal Commission) HB 1383, as amended by House Amendment 3, would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness.
