2    AMENDMENT NO. ______. Amend Senate Bill 3048, AS AMENDED,
3by replacing everything after the enacting clause with the

5    "Section 5. The Freedom of Information Act is amended by
6changing Section 7.5 as follows:

10    Sec. 7.5. Statutory exemptions. To the extent provided for
11by the statutes referenced below, the following shall be
12exempt from inspection and copying:
13        (a) All information determined to be confidential
14    under Section 4002 of the Technology Advancement and
15    Development Act.

7    Procedures Board or its staff relating to applications it
8    has received.
9        (d) Information and records held by the Department of
10    Public Health and its authorized representatives relating
11    to known or suspected cases of sexually transmitted
12    infection or any information the disclosure of which is
13    restricted under the Illinois Sexually Transmitted
14    Infection Control Act.
15        (e) Information the disclosure of which is exempted
16    under Section 30 of the Radon Industry Licensing Act.
17        (f) Firm performance evaluations under Section 55 of
18    the Architectural, Engineering, and Land Surveying
19    Qualifications Based Selection Act.
20        (g) Information the disclosure of which is restricted
21    and exempted under Section 50 of the Illinois Prepaid
22    Tuition Act.
23        (h) Information the disclosure of which is exempted
24    under the State Officials and Employees Ethics Act, and
25    records of any lawfully created State or local inspector
26    general's office that would be exempt if created or

1    obtained by an Executive Inspector General's office under
2    that Act.
3        (i) Information contained in a local emergency energy
4    plan submitted to a municipality in accordance with a
5    local emergency energy plan ordinance that is adopted

7        (j) Information and data concerning the distribution
8    of surcharge moneys collected and remitted by carriers
9    under the Emergency Telephone System Act.
10        (k) Law enforcement officer identification information
11    or driver identification information compiled by a law
12    enforcement agency or the Department of Transportation
13    under Section 11-212 of the Illinois Vehicle Code.
14        (l) Records and information provided to a residential
15    health care facility resident sexual assault and death
16    review team or the Executive Council under the Abuse
17    Prevention Review Team Act.
18        (m) Information provided to the predatory lending
19    database created pursuant to Article 3 of the Residential
20    Real Property Disclosure Act, except to the extent
21    authorized under that Article.
22        (n) Defense budgets and petitions for certification of
23    compensation and expenses for court appointed trial
24    counsel as provided under Sections 10 and 15 of the
25    Capital Crimes Litigation Act (repealed). This subsection
26    (n) shall apply until the conclusion of the trial of the

1    case, even if the prosecution chooses not to pursue the
2    death penalty prior to trial or sentencing.
3        (o) Information that is prohibited from being

7    investigation reports, surveys, schedules, lists, data, or
8    information compiled, collected, or prepared by or for the
9    Department of Transportation under Sections 2705-300 and

12    Transportation Authority under Section 2.11 of the
13    Regional Transportation Authority Act, or the St. Clair

24    team of experts under the Developmental Disability and

10        (v-5) Records of the Firearm Owner's Identification
11    Card Review Board that are exempted from disclosure under
12    Section 10 of the Firearm Owners Identification Card Act.
13        (w) Personally identifiable information which is
14    exempted from disclosure under subsection (g) of Section
15    19.1 of the Toll Highway Act.
16        (x) Information which is exempted from disclosure
17    under Section 5-1014.3 of the Counties Code or Section
18    8-11-21 of the Illinois Municipal Code.
19        (y) Confidential information under the Adult
20    Protective Services Act and its predecessor enabling
21    statute, the Elder Abuse and Neglect Act, including
22    information about the identity and administrative finding
23    against any caregiver of a verified and substantiated
24    decision of abuse, neglect, or financial exploitation of
25    an eligible adult maintained in the Registry established

11        (k) Law enforcement officer identification information
12    or driver identification information compiled by a law
13    enforcement agency or the Department of Transportation
14    under Section 11-212 of the Illinois Vehicle Code.
15        (l) Records and information provided to a residential
16    health care facility resident sexual assault and death
17    review team or the Executive Council under the Abuse
18    Prevention Review Team Act.
19        (m) Information provided to the predatory lending
20    database created pursuant to Article 3 of the Residential
21    Real Property Disclosure Act, except to the extent
22    authorized under that Article.
23        (n) Defense budgets and petitions for certification of
24    compensation and expenses for court appointed trial
25    counsel as provided under Sections 10 and 15 of the
26    Capital Crimes Litigation Act (repealed). This subsection

1    (n) shall apply until the conclusion of the trial of the

2    Sec. 2605-51. Division of the Academy and Training.
3    (a) The Division of the Academy and Training shall
4exercise, but not be limited to, the following functions:
5        (1) Oversee and operate the Illinois State Police
6    Training Academy.
7        (2) Train and prepare new officers for a career in law
8    enforcement, with innovative, quality training and
9    educational practices.
10        (3) Offer continuing training and educational programs
11    for Illinois State Police employees.
12        (4) Oversee the Illinois State Police's recruitment
13    initiatives.
14        (5) Oversee and operate the Illinois State Police's
15    quartermaster.
16        (6) Duties assigned to the Illinois State Police in
17    Article 5, Chapter 11 of the Illinois Vehicle Code
18    concerning testing and training officers on the detection
19    of impaired driving.
20        (7) Duties assigned to the Illinois State Police in

2Satisfactory completion shall be evidenced by a commission or
3certificate issued to the officer.
4    (b) The Division of the Academy and Training shall
5exercise the rights, powers, and duties vested in the former
6Division of State Troopers by Section 17 of the Illinois State
7Police Act.
8    (c) Specialized training. The Division of the Academy and
9Training shall provide the following specialized training:
10        (1) Crash reconstruction specialist; training. The
11    Division of the Academy and Training shall cooperate with
12    the Division of Forensic Services to provide specialized
13    training in crash reconstruction for Illinois State Police
14    officers. Only Illinois State Police officers who
15    successfully complete the training may be assigned as
16    crash reconstruction specialists.
17        (2) Death and homicide investigations; training. The
18    Division of the Academy and Training shall provide
19    training in death and homicide investigation for Illinois
20    State Police officers. Only Illinois State Police officers
21    who successfully complete the training may be assigned as
22    lead investigators in death and homicide investigations.
23    Satisfactory completion of the training shall be evidenced
24    by a certificate issued to the officer by the Division of
25    the Academy and Training. The Director shall develop a
26    process for waiver applications for officers whose prior

1    training and experience as homicide investigators may
2    qualify them for a waiver. The Director may issue a
3    waiver, at his or her discretion, based solely on the
4    prior training and experience of an officer as a homicide
5    investigator.
6            (A) The Division of the Academy and Training shall
7        require all homicide investigator training to include
8        instruction on victim-centered, trauma-informed
9        investigation. This training must be implemented by
10        July 1, 2023.
11            (B) The Division of the Academy and Training shall
12        cooperate with the Division of Criminal Investigation
13        to develop a model curriculum on victim-centered,
14        trauma-informed investigation. This curriculum must be
15        implemented by July 1, 2023.
16        (3) Investigation of officer-involved criminal sexual
17    assault; training. The Division of the Academy and
18    Training shall cooperate with the Division of Criminal
19    Investigation to provide a specialized criminal sexual
20    assault and sexual abuse investigation training program
21    for Illinois State Police officers. Only Illinois State
22    Police officers who successfully complete the training may
23    be assigned as investigators in officer-involved criminal
24    sexual assault investigations under Section 10 of the Law
25    Enforcement Criminal Sexual Assault Investigation Act.
26        (4) Investigation of officer-involved deaths;

1    training. The Division of the Academy and Training shall
2    have a written policy regarding the investigation of
3    officer-involved deaths that involve a law enforcement
4    officer employed by the Illinois State Police as required
5    under Section 1-10 of the Police and Community Relations
6    Improvement Act and shall provide specialized training in
7    that policy for Illinois State Police officers.
8        (5) Juvenile specialist; training. The Division of the
9    Academy and Training shall provide specialized juvenile
10    training for Illinois State Police officers who meet the
11    definition of "juvenile police officer" as defined under
12    paragraph (17) of Section 1-3 of the Juvenile Court Act of
13    1987. Juvenile specialists may complete questioning of
14    juveniles on school grounds as provided under Section
15    22-88 of the School Code.
16        (6) Peer support program; training. The Division of
17    the Academy and Training shall cooperate with the Office
18    of the Director to provide peer support advisors with
19    appropriate specialized training in counseling to conduct
20    peer support counseling sessions under Section 10 of the
21    First Responders Suicide Prevention Act.
22        (7) Police dog training standards; training. All
23    police dogs used by the Illinois State Police for drug
24    enforcement purposes pursuant to the Cannabis Control Act,
25    the Illinois Controlled Substances Act, and the
26    Methamphetamine Control and Community Protection Act shall

1    be trained by programs that meet the certification
2    requirements set by the Director or the Director's
3    designee. Satisfactory completion of the training shall be
4    evidenced by a certificate issued by the Division of the
5    Academy and Training.
6        (8) Safe2Help; training. The Division of the Academy
7    and Training shall cooperate with the Division of Criminal
8    Investigation to ensure all program personnel or call
9    center staff, or both, are appropriately trained in the
10    areas described in subsection (f) of Section 10 of the
11    Student Confidential Reporting Act. (10)
12    (c-5) In-service training.
13        (1) At least once, the Division of the Academy and
14    Training shall develop and require the following
15    in-service training opportunities to be completed by
16    Illinois State Police officers:
17            (A) Cell phone medical information; training.
18        Training required under this subparagraph (A) shall
19        provide instruction on accessing and using medical
20        information stored in cell phones. The Division may
21        use the program approved under Section 2310-711 of the
22        Department of Public Health Powers and Duties Law of
23        the Civil Administrative Code of Illinois to develop
24        the Division's program.
25            (B) Autism spectrum disorders; training. Training
26        required under this subparagraph (B) shall instruct

1        Illinois State Police officers on the nature of autism
2        spectrum disorders and in identifying and
3        appropriately responding to individuals with autism
4        spectrum disorders. The Illinois State Police shall
5        review the training curriculum and may consult with
6        the Department of Public Health or the Department of
7        Human Services to update the training curriculum as
8        needed.
9            (C) Lethality assessment; training. The training
10        required under this subparagraph (C) shall provide
11        instruction on the policies and procedures for
12        administering a lethality assessment, including how
13        referrals to domestic violence services are to be
14        handled by the law enforcement agency.
15        (2) At least every year, the Division of the Academy
16    and Training shall provide the following in-service
17    training to Illinois State Police officers:
18            (A) Cultural diversity; training.
19                (i) Training required under this subparagraph
20            (A) shall provide training and continuing
21            education to Illinois State Police officers
22            concerning cultural diversity, including topics
23            such as sensitivity toward racial and ethnic
24            differences.
25                (ii) This training and continuing education
26            shall, among other things, emphasize that the

1            primary purpose of enforcement of the Illinois
2            Vehicle Code is safety and equal, uniform, and
3            non-discriminatory enforcement of the law.
4            (B) Minimum annual in-service training
5        requirements. Minimum annual in-service training
6        includes:
7                (i) crisis intervention training;
8                (ii) emergency medical response training and
9            certification;
10                (iii) firearm qualification training;
11                (iv) law updates; and
12                (v) officer wellness and mental health.
13            (C) Firearms restraining orders; training.
14        Training required under this subparagraph (C) shall
15        provide instruction on the processes used to file a
16        firearms restraining order, to identify situations in
17        which a firearms restraining order is appropriate, and
18        to safely promote the usage of the firearms
19        restraining order in different situations.
20        (3) At least every 3 years, the Division of the
21    Academy and Training shall provide the following
22    in-service training to Illinois State Police officers:
23            (A) Arrest and use of force and control tactics;
24        training. Training required under this subparagraph
25        (A) shall provide to Illinois State Police officers
26        training and continuing education concerning knowledge

1        of policies and laws regulating the use of force;
2        shall equip officers with tactics and skills,
3        including de-escalation techniques, to prevent or
4        reduce the need to use force or, when force must be
5        used, to use force that is objectively reasonable,
6        necessary, and proportional under the totality of the
7        circumstances; and shall ensure appropriate
8        supervision and accountability. The training shall
9        consist of at least 30 hours and shall include:
10                (i) at least 12 hours of hands-on,
11            scenario-based role-playing;
12                (ii) at least 6 hours of instruction on use of
13            force techniques, including the use of
14            de-escalation techniques to prevent or reduce the
15            need for force whenever safe and feasible;
16                (iii) specific training on the law concerning
17            stops, searches, and the use of force under the
18            Fourth Amendment to the United States
19            Constitution;
20                (iv) specific training on officer safety
21            techniques, including cover, concealment, and
22            time; and
23                (v) at least 6 hours of training focused on
24            high-risk traffic stops.
25            (B) Minimum triennial in-service training
26        requirements. Minimum triennial in-service training

2        training and continuing education to Illinois State
3        Police officers concerning:
4                (i) constitutional and proper use of law

8            bias and racial and ethnic sensitivity; and
9                (iv) procedural justice.
10            (C) Mandated reporter; training. Training required
11        under this subparagraph (C) must be approved by the
12        Department of Children and Family Services as provided
13        under Section 4 of the Abused and Neglected Child
14        Reporting Act and includes training on the reporting
15        of child abuse and neglect.
16            (D) Sexual assault and sexual abuse; training.
17                (i) Training required under this subparagraph
18            (D) shall include in-service training on sexual
19            assault and sexual abuse response and training on
20            report writing requirements, including, but not
21            limited to, the following:
22                    (a) recognizing the symptoms of trauma;
23                    (b) understanding the role trauma has
24                played in a victim's life;
25                    (c) responding to the needs and concerns
26                of a victim;

1                    (d) delivering services in a
2                compassionate, sensitive, and nonjudgmental
3                manner;
4                    (e) interviewing techniques in accordance
5                with the curriculum standards in subdivision
6                (iii) of this subparagraph;
7                    (f) understanding cultural perceptions and
8                common myths of sexual assault and sexual
9                abuse; and
10                    (g) report writing techniques in
11                accordance with the curriculum standards in
12                subdivision (iii) of this subparagraph and the
13                Sexual Assault Incident Procedure Act.
14                (ii) Instructors providing training under this
15            subparagraph (D) (G) shall have successfully
16            completed training on evidence-based,
17            trauma-informed, victim-centered responses to
18            cases of sexual assault and sexual abuse and shall
19            have experience responding to sexual assault and
20            sexual abuse cases.
21                (iii) The Illinois State Police shall adopt
22            rules, in consultation with the Office of the
23            Attorney General and the Illinois Law Enforcement
24            Training Standards Board, to determine the
25            specific training requirements. The rules adopted
26            by the Illinois State Police shall include, at a

1            minimum, both of the following:
2                    (a) evidence-based curriculum standards
3                for report writing and immediate response to
4                sexual assault and sexual abuse, including
5                trauma-informed, victim-centered interview
6                techniques, which have been demonstrated to
7                minimize retraumatization, for all Illinois
8                State Police officers; and
9                    (b) evidence-based curriculum standards
10                for trauma-informed, victim-centered
11                investigation and interviewing techniques,
12                which have been demonstrated to minimize
13                retraumatization, for cases of sexual assault
14                and sexual abuse for all Illinois State Police
15                officers who conduct sexual assault and sexual
16                abuse investigations.
17        (4) At least every 5 years, the Division of the
18    Academy and Training shall provide the following
19    in-service training to Illinois State Police officers:
20            (A) Psychology of domestic violence; training.
21        Training under this subparagraph (A) shall provide aid
22        in understanding the actions of domestic violence
23        victims and abusers and the actions needed to prevent
24        further victimization of those who have been abused.
25        The training shall focus specifically on looking
26        beyond physical evidence to the psychology of domestic

1        violence situations by studying the dynamics of the
2        aggressor-victim relationship, separately evaluating
3        claims where both parties claim to be the victim, and
4        assessing the long-term effects of domestic violence
5        situations.
6    (c-10) Cadet training. The Division of the Academy and
7Training shall provide the following basic training to
8Illinois State Police cadets or ensure the following training
9was completed prior to an Illinois State Police cadet becoming
10an Illinois State Police officer:
11        (1) Animal fighting awareness and humane response;
12    training. Training required under this paragraph (1) shall
13    include a training program in animal fighting awareness
14    and humane response for Illinois State Police cadets. The
15    purpose of that training shall be for Illinois State
16    Police officers to identify animal fighting operations and
17    respond appropriately. Training under this paragraph (1)
18    shall include a humane response component that provides
19    guidelines for appropriate law enforcement response to
20    animal abuse, cruelty, and neglect, or similar condition,
21    as well as training on canine behavior and nonlethal ways
22    to subdue a canine.
23        (2) Arrest and use of force and control tactics and
24    officer safety; training. Training required under this
25    paragraph (2) must include, without limitation, training
26    on officer safety techniques, such as cover, concealment,

1    and time.
2        (3) Arrest of a parent or an immediate family member;
3    training. Training required under this paragraph (3) shall
4    instruct Illinois State Police cadets on trauma-informed
5    responses designed to ensure the physical safety and
6    well-being of a child of an arrested parent or immediate
7    family member, which must include, without limitation: (A)
8    training in understanding the trauma experienced by the
9    child while maintaining the integrity of the arrest and
10    safety of officers, suspects, and other involved
11    individuals; (B) training in de-escalation tactics that
12    would include the use of force when reasonably necessary;
13    and (C) training in understanding and inquiring whether a
14    child will require supervision and care.
15        (4) Autism and other developmental or physical
16    disabilities; training. Training required under this
17    paragraph (4) shall instruct Illinois State Police cadets
18    on identifying and interacting with persons with autism
19    and other developmental or physical disabilities, reducing
20    barriers to reporting crimes against persons with autism,
21    and addressing the unique challenges presented by cases
22    involving victims or witnesses with autism and other
23    developmental disabilities.
24        (5) Cell phone medical information; training. Training
25    required under this paragraph (5) shall instruct Illinois
26    State Police cadets to access and use medical information

1    stored in cell phones. The Division of the Academy and
2    Training may use the program approved under Section
3    2310-711 of the Department of Public Health Powers and
4    Duties Law of the Civil Administrative Code of Illinois to
5    develop the training required under this paragraph (5).
6        (6) Compliance with the Health Care Violence
7    Prevention Act; training. Training required under this
8    paragraph (6) shall provide an appropriate level of
9    training for Illinois State Police cadets concerning the
10    Health Care Violence Prevention Act.
11        (7) Constitutional law; training. Training required
12    under this paragraph (7) shall instruct Illinois State
13    Police cadets on constitutional and proper use of law
14    enforcement authority, procedural justice, civil rights,
15    human rights, and cultural competency, including implicit
16    bias and racial and ethnic sensitivity.
17        (8) Courtroom testimony; training.
18        (9) Crime victims; training. Training required under
19    this paragraph (9) shall provide instruction in techniques
20    designed to promote effective communication at the initial
21    contact with crime victims and to comprehensively explain
22    to victims and witnesses their rights under the Rights of
23    Crime Victims and Witnesses Act and the Crime Victims
24    Compensation Act.
25        (10) Criminal law; training.
26        (11) Crisis intervention team and mental health

1    awareness; training. Training required under this
2    paragraph (11) shall include a specialty certification
3    course of at least 40 hours, addressing specialized
4    policing responses to people with mental illnesses. The
5    Division of the Academy and Training shall conduct Crisis
6    Intervention Team training programs that train officers to
7    identify signs and symptoms of mental illness, to
8    de-escalate situations involving individuals who appear to
9    have a mental illness and connect individuals in crisis to
10    treatment.
11        (12) Cultural diversity; training.
12            (A) The training required under this paragraph
13        (12) shall provide training to Illinois State Police
14        cadets concerning cultural competency and cultural
15        diversity, including sensitivity toward racial and
16        ethnic differences.
17            (B) This training shall include, but not be
18        limited to, an emphasis on the fact that the primary
19        purpose of enforcement of the Illinois Vehicle Code is
20        safety, equal, and uniform and non-discriminatory
21        enforcement under the law.
22        (13) De-escalation and use of force; training.
23    Training required under this paragraph (13) must consist
24    of at least 6 hours of instruction on use of force
25    techniques, including the use of de-escalation techniques
26    to prevent or reduce the need for force whenever safe and

1    feasible.
2        (14) Domestic violence; training. Training required
3    under this paragraph (14) shall provide aid in
4    understanding the actions of domestic violence victims and
5    abusers and to prevent further victimization of those who
6    have been abused, focusing specifically on looking beyond
7    the physical evidence to the psychology of domestic
8    violence situations, such as the dynamics of the
9    aggressor-victim relationship, separately evaluating
10    claims where both parties claim to be the victim, and
11    long-term effects. This training shall also include
12    instruction on the policies and procedures for
13    administering a lethality assessment, including how
14    referrals to domestic violence services would be handled
15    by the law enforcement agency.
16        (15) Effective recognition of and responses to stress,
17    trauma, and post-traumatic stress; training. Training
18    required under this paragraph (15) shall instruct Illinois
19    State Police cadets to recognize and respond to stress,
20    trauma, and post-traumatic stress experienced by law
21    enforcement officers. The training must be consistent with
22    Section 25 of the Illinois Mental Health First Aid
23    Training Act in a peer setting, including recognizing
24    signs and symptoms of work-related cumulative stress,
25    issues that may lead to suicide, and solutions for
26    intervention with peer support resources.

1        (16) Elder abuse; training. Training required under
2    this paragraph (16) shall teach Illinois State Police
3    cadets to recognize neglect and financial exploitation
4    against the elderly and adults with disabilities. The
5    training shall also teach Illinois State Police cadets to
6    recognize self-neglect by the elderly and adults with
7    disabilities. In this subparagraph, "adults with
8    disabilities" has the meaning given to that term in the
9    Adult Protective Services Act.
10        (17) Electronic control devices; training. Training
11    required under this paragraph (17) shall include training
12    in the use of electronic control devices, including the
13    psychological and physiological effects of the use of
14    those devices on humans.
15        (18) Epinephrine auto-injector administration;
16    training. Training required under this paragraph (18)
17    shall instruct Illinois State Police cadets to recognize
18    and respond to anaphylaxis. The training must comply with
19    subsection (c) of Section 40 of the Illinois State Police
20    Act.
21        (19) Evidence collection; training. Training required
22    under this paragraph (19) must include proper procedures
23    for collecting, handling, and preserving evidence, and
24    rules of law.
25        (20) Firearms restraining orders; training. Providing
26    instruction on the process used to file a firearms

1    restraining order and how to identify situations in which
2    a firearms restraining order is appropriate and how to
3    safely promote the usage of the firearms restraining order
4    in different situations.
5        (21) Firearms; training. Successful completion of a
6    40-hour course of training in use of a suitable type
7    firearm shall be a condition precedent to the possession
8    and use of that respective firearm in connection with the
9    officer's official duties. To satisfy the requirements of
10    this Act, the training must include the following:
11            (A) Instruction in the dangers of misuse of the
12        firearm, safety rules, and care and cleaning of the
13        firearm.
14            (B) Practice firing on a range and qualification
15        with the firearm in accordance with the standards
16        established by the Board.
17            (C) Instruction in the legal use of firearms under
18        the Criminal Code of 2012 and relevant court
19        decisions.
20            (D) A forceful presentation of the ethical and
21        moral considerations assumed by any person who uses a
22        firearm.
23        (22) First-aid; training. First-aid training must
24    include cardiopulmonary resuscitation.
25        (23) Hate crimes; training. Training required under
26    this paragraph (23) shall instruct Illinois State Police

1    cadets in identifying, responding to, and reporting all
2    hate crimes.
3        (24) High-risk traffic stops; training. Training
4    required under this paragraph (24) must consist of at
5    least 6 hours of training focused on high-risk traffic
6    stops.
7        (25) High-speed vehicle chase; training. Training
8    required under this paragraph (25) shall instruct Illinois
9    State Police cadets on the hazards of high-speed police
10    vehicle chases with an emphasis on alternatives to the
11    high-speed vehicle chase.
12        (26) Human relations; training.
13        (27) Human trafficking; training. Training required
14    under this paragraph (27) shall instruct Illinois State
15    Police cadets in the detection and investigation of all
16    forms of human trafficking, including, but not limited to,
17    involuntary servitude under subsection (b) of Section 10-9
18    of the Criminal Code of 2012, involuntary sexual servitude
19    of a minor under subsection (c) of Section 10-9 of the
20    Criminal Code of 2012, and trafficking in persons under
21    subsection (d) of Section 10-9 of the Criminal Code of
22    2012. This program shall be made available to all cadets
23    and Illinois State Police officers.
24        (28) Juvenile law; training. Training required under
25    this paragraph (28) shall instruct Illinois State Police
26    cadets on juvenile law and the proper processing and

1    handling of juvenile offenders.
2        (29) Mandated reporter; training. Training required
3    under this paragraph (29) must be approved by the
4    Department of Children and Family Services as provided
5    under Section 4 of the Abused and Neglected Child
6    Reporting Act and includes training on the reporting of
7    child abuse and neglect.
8        (30) Mental conditions and crises, training. Training
9    required under this paragraph (30) shall include, without
10    limitation, (A) recognizing the disease of addiction, (B)
11    recognizing situations which require immediate assistance,
12    and (C) responding in a manner that safeguards and
13    provides assistance to individuals in need of mental
14    treatment.
15        (31) Officer wellness and suicide prevention;
16    training. The training required under this paragraph (31)
17    shall include instruction on job-related stress management
18    techniques, skills for recognizing signs and symptoms of
19    work-related cumulative stress, recognition of other
20    issues that may lead to officer suicide, solutions for
21    intervention, and a presentation on available peer support
22    resources.
23        (32) Officer-worn body cameras; training.
24            (A) As used in this paragraph (32), "officer-worn
25        body camera" has the meaning given to that term in
26        Article 10 of the Law Enforcement Officer-Worn Body

1        Camera Act.
2            (B) The training required under this paragraph
3        (32) shall provide training in the use of officer-worn
4        body cameras to cadets who will use officer-worn body
5        cameras.
6        (33) Opioid antagonists; training.
7            (A) As used in this paragraph (33), "opioid
8        antagonist" has the meaning given to that term in
9        subsection (e) of Section 5-23 of the Substance Use
10        Disorder Act.
11            (B) Training required under this paragraph (33)
12        shall instruct Illinois State Police cadets to
13        administer opioid antagonists.
14        (34) Persons arrested while under the influence of
15    alcohol or drugs; training. Training required under this
16    paragraph (34) shall comply with Illinois State Police
17    policy adopted under Section 2605-54. The training shall
18    be consistent with the Substance Use Disorder Act and
19    shall provide guidance for the arrest of persons under the
20    influence of alcohol or drugs, proper medical attention if
21    warranted, and care and release of those persons from
22    custody. The training shall provide guidance concerning
23    the release of persons arrested under the influence of
24    alcohol or drugs who are under the age of 21 years of age,
25    which shall include, but shall not be limited to,
26    instructions requiring the arresting officer to make a

1    reasonable attempt to contact a responsible adult who is
2    willing to take custody of the person who is under the
3    influence of alcohol or drugs.
4        (35) Physical training.
5        (36) Post-traumatic stress disorder; training.
6    Training required under this paragraph (36) shall equip
7    Illinois State Police cadets to identify the symptoms of
8    post-traumatic stress disorder and to respond
9    appropriately to individuals exhibiting those symptoms.
10        (37) Report writing; training. Training required under
11    this paragraph (37) shall instruct Illinois State Police
12    cadets on writing reports and proper documentation of
13    statements.
14        (38) Scenario training. At least 12 hours of hands-on,
15    scenario-based role-playing.
16        (39) Search and seizure; training. Training required
17    under this paragraph (39) shall instruct Illinois State
18    Police cadets on search and seizure, including temporary
19    questioning.
20        (40) Sexual assault and sexual abuse; training.
21    Training required under this paragraph (40) shall instruct
22    Illinois State Police cadets on sexual assault and sexual
23    abuse response and report writing training requirements,
24    including, but not limited to, the following:
25            (A) recognizing the symptoms of trauma;
26            (B) understanding the role trauma has played in a

1        victim's life;
2            (C) responding to the needs and concerns of a
3        victim;
4            (D) delivering services in a compassionate,

8        10.19 of the Illinois Police Training Act;
9            (F) understanding cultural perceptions and common
10        myths of sexual assault and sexual abuse; and
11            (G) report-writing techniques in accordance with
12        the curriculum standards in subsection (f) of Section
13        10.19 of the Illinois Police Training Act and the
14        Sexual Assault Incident Procedure Act.
15        (41) Traffic control and crash investigation;
16    training.
17    (d) The Division of the Academy and Training shall
18administer and conduct a program consistent with 18 U.S.C.
19926B and 926C for qualified active and retired Illinois State
20Police officers.

6    officers which shall be offered by all certified schools
7    shall include, but not be limited to, courses of
8    procedural justice, arrest and use and control tactics,
9    search and seizure, including temporary questioning, civil
10    rights, human rights, human relations, cultural
11    competency, including implicit bias and racial and ethnic
12    sensitivity, criminal law, law of criminal procedure,
13    constitutional and proper use of law enforcement
14    authority, crisis intervention training, vehicle and
15    traffic law including uniform and non-discriminatory
16    enforcement of the Illinois Vehicle Code, traffic control
17    and crash investigation, techniques of obtaining physical
18    evidence, court testimonies, statements, reports, firearms
19    training, training in the use of electronic control
20    devices, including the psychological and physiological
21    effects of the use of those devices on humans, first aid
22    (including cardiopulmonary resuscitation), training in the
23    administration of opioid antagonists as defined in
24    paragraph (1) of subsection (e) of Section 5-23 of the
25    Substance Use Disorder Act, handling of juvenile

2    including, but not limited to, the disease of addiction,
3    which require immediate assistance and response and

6    financial exploitation, and self-neglect of adults with
7    disabilities and older adults, as defined in Section 2 of
8    the Adult Protective Services Act, crimes against the
9    elderly, law of evidence, the hazards of high-speed police
10    vehicle chases with an emphasis on alternatives to the
11    high-speed chase, and physical training. The curriculum
12    shall include a block of instruction addressing
13    trauma-informed programs, procedures, and practices meant
14    to minimize traumatization of the victim. The curriculum
15    shall include specific training in techniques for
16    immediate response to and investigation of cases of
17    domestic violence, including domestic violence lethality
18    assessments, and of sexual assault of adults and children,
19    including cultural perceptions and common myths of sexual
20    assault and sexual abuse as well as interview techniques
21    that are age sensitive and are trauma informed, victim
22    centered, and victim sensitive. The curriculum shall
23    include training in techniques designed to promote
24    effective communication at the initial contact with crime
25    victims and ways to comprehensively explain to victims and
26    witnesses their rights under the Rights of Crime Victims

1    and Witnesses Act and the Crime Victims Compensation Act.
2    The curriculum shall also include training in effective
3    recognition of and responses to stress, trauma, and
4    post-traumatic stress experienced by law enforcement
5    officers that is consistent with Section 25 of the
6    Illinois Mental Health First Aid Training Act in a peer
7    setting, including recognizing signs and symptoms of
8    work-related cumulative stress, issues that may lead to
9    suicide, and solutions for intervention with peer support
10    resources. The curriculum shall include a block of
11    instruction addressing the mandatory reporting
12    requirements under the Abused and Neglected Child
13    Reporting Act. The curriculum shall also include a block
14    of instruction aimed at identifying and interacting with
15    persons with autism and other developmental or physical
16    disabilities, reducing barriers to reporting crimes
17    against persons with autism, and addressing the unique
18    challenges presented by cases involving victims or
19    witnesses with autism and other developmental
20    disabilities. The curriculum shall include training in the
21    detection and investigation of all forms of human
22    trafficking. The curriculum shall also include instruction
23    in trauma-informed responses designed to ensure the
24    physical safety and well-being of a child of an arrested
25    parent or immediate family member; this instruction must
26    include, but is not limited to: (1) understanding the

1    trauma experienced by the child while maintaining the
2    integrity of the arrest and safety of officers, suspects,
3    and other involved individuals; (2) de-escalation tactics
4    that would include the use of force when reasonably
5    necessary; and (3) inquiring whether a child will require
6    supervision and care. The curriculum for probationary law
7    enforcement officers shall include: (1) at least 12 hours
8    of hands-on, scenario-based role-playing; (2) at least 6
9    hours of instruction on use of force techniques, including
10    the use of de-escalation techniques to prevent or reduce
11    the need for force whenever safe and feasible; (3)
12    specific training on officer safety techniques, including
13    cover, concealment, and time; and (4) at least 6 hours of
14    training focused on high-risk traffic stops. The
15    curriculum for permanent law enforcement officers shall
16    include, but not be limited to: (1) refresher and
17    in-service training in any of the courses listed above in
18    this subparagraph, (2) advanced courses in any of the
19    subjects listed above in this subparagraph, (3) training
20    for supervisory personnel, and (4) specialized training in
21    subjects and fields to be selected by the board. The
22    training in the use of electronic control devices shall be
23    conducted for probationary law enforcement officers,
24    including University police officers. The curriculum shall
25    also include training on the use of a firearms restraining
26    order by providing instruction on the process used to file

1    a firearms restraining order and how to identify
2    situations in which a firearms restraining order is
3    appropriate.
4        b. Minimum courses of study, attendance requirements
5    and equipment requirements.
6        c. Minimum requirements for instructors.
7        d. Minimum basic training requirements, which a
8    probationary law enforcement officer must satisfactorily
9    complete before being eligible for permanent employment as
10    a local law enforcement officer for a participating local
11    governmental or State governmental agency. Those
12    requirements shall include training in first aid
13    (including cardiopulmonary resuscitation).
14        e. Minimum basic training requirements, which a
15    probationary county corrections officer must
16    satisfactorily complete before being eligible for
17    permanent employment as a county corrections officer for a
18    participating local governmental agency.
19        f. Minimum basic training requirements which a
20    probationary court security officer must satisfactorily
21    complete before being eligible for permanent employment as
22    a court security officer for a participating local
23    governmental agency. The Board shall establish those
24    training requirements which it considers appropriate for
25    court security officers and shall certify schools to
26    conduct that training.

1        A person hired to serve as a court security officer
2    must obtain from the Board a certificate (i) attesting to
3    the officer's successful completion of the training
4    course; (ii) attesting to the officer's satisfactory
5    completion of a training program of similar content and
6    number of hours that has been found acceptable by the
7    Board under the provisions of this Act; or (iii) attesting
8    to the Board's determination that the training course is
9    unnecessary because of the person's extensive prior law
10    enforcement experience.
11        Individuals who currently serve as court security
12    officers shall be deemed qualified to continue to serve in
13    that capacity so long as they are certified as provided by
14    this Act within 24 months of June 1, 1997 (the effective
15    date of Public Act 89-685). Failure to be so certified,
16    absent a waiver from the Board, shall cause the officer to
17    forfeit his or her position.
18        All individuals hired as court security officers on or
19    after June 1, 1997 (the effective date of Public Act
20    89-685) shall be certified within 12 months of the date of
21    their hire, unless a waiver has been obtained by the
22    Board, or they shall forfeit their positions.
23        The Sheriff's Merit Commission, if one exists, or the
24    Sheriff's Office if there is no Sheriff's Merit
25    Commission, shall maintain a list of all individuals who
26    have filed applications to become court security officers

1    and who meet the eligibility requirements established
2    under this Act. Either the Sheriff's Merit Commission, or
3    the Sheriff's Office if no Sheriff's Merit Commission
4    exists, shall establish a schedule of reasonable intervals
5    for verification of the applicants' qualifications under
6    this Act and as established by the Board.
7        g. Minimum in-service training requirements, which a
8    law enforcement officer must satisfactorily complete every
9    3 years. Those requirements shall include constitutional
10    and proper use of law enforcement authority; procedural
11    justice; civil rights; human rights; reporting child abuse
12    and neglect; autism-informed law enforcement responses,
13    techniques, and procedures; trauma-informed programs,
14    procedures, and practices meant to minimize traumatization
15    of the victim; and cultural competency, including implicit
16    bias and racial and ethnic sensitivity. These trainings
17    shall consist of at least 30 hours of training every 3
18    years.
19        h. Minimum in-service training requirements, which a
20    law enforcement officer must satisfactorily complete at
21    least annually. Those requirements shall include law
22    updates, emergency medical response training and
23    certification, crisis intervention training, and officer
24    wellness and mental health.
25        i. Minimum in-service training requirements as set
26    forth in Section 10.6.

6    Section 20. The Illinois Domestic Violence Act of 1986 is
7amended by changing Sections 301.1 and 304 as follows:

9    Sec. 301.1. Law enforcement policies.
10    (a) Every law enforcement agency shall develop, adopt, and
11implement written policies regarding arrest procedures for
12domestic violence incidents consistent with the provisions of
13this Act. In developing these policies, each law enforcement
14agency shall consult with community organizations and other
15law enforcement agencies with expertise in recognizing and
16handling domestic violence incidents.
17    (b) In the initial training of new recruits and every 5
18years in the continuing education of law enforcement officers,
19every law enforcement agency shall provide training to aid in
20understanding the actions of domestic violence victims and
21abusers and to prevent further victimization of those who have
22been abused, focusing specifically on looking beyond the
23physical evidence to the psychology of domestic violence
24situations, such as the dynamics of the aggressor-victim

1relationship, separately evaluating claims where both parties
2claim to be the victim, and long-term effects.
3    Beginning January 1, 2028, the continuing education shall
4include training on the policies and procedures for
5administering a lethality assessment.
6    The Law Enforcement Training Standards Board shall
7formulate and administer the training under this subsection
8(b) as part of the current programs for both new recruits and
9active law enforcement officers. The Board shall formulate the
10training by July 1, 2017, and implement the training statewide
11by July 1, 2018. In formulating the training, the Board shall
12work with community organizations with expertise in domestic
13violence to determine which topics to include. The Law
14Enforcement Training Standards Board shall oversee the
15implementation and continual administration of the training.
16    (c) On or before July 1, 2031, every law enforcement
17agency shall provide to all of its law enforcement officers
18instruction on the policies and procedures for administering a
19lethality assessment under Section 304. A law enforcement
20officer may not administer a lethality assessment under
21Section 304 if the law enforcement officer has not received
22instruction on administering a lethality assessment.

1    (a) Whenever a law enforcement officer has reason to
2believe that a person has been abused, neglected, or exploited
3by a family or household member, the officer shall immediately
4use all reasonable means to prevent further abuse, neglect, or
5exploitation, including:
6        (1) Arresting the abusing, neglecting, and exploiting
7    party, if appropriate. However, if the alleged offender is
8    a juvenile, then the officer, based on the totality of the
9    circumstances and using the Adolescent Domestic Battery
10    Typology Tool, may choose not to arrest the juvenile and
11    instead may divert the juvenile or may assist the juvenile
12    and the juvenile's family in finding alternative
13    placement. In any situation in which law enforcement does
14    not make an arrest under this Act, the officer shall
15    forward the report of the incident to the State's
16    Attorney's office for review;
17        (2) If there is probable cause to believe that
18    particular weapons were used to commit the incident of
19    abuse, subject to constitutional limitations, seizing and
20    taking inventory of the weapons;
21        (3) Accompanying the victim of abuse, neglect, or
22    exploitation to his or her place of residence for a
23    reasonable period of time to remove necessary personal
24    belongings and possessions;
25        (4) Offering the victim of abuse, neglect, or
26    exploitation immediate and adequate information (written

1    in a language appropriate for the victim or in Braille or
2    communicated in appropriate sign language), which shall
3    include a summary of the procedures and relief available
4    to victims of abuse under subsection (c) of Section 217
5    and the officer's name and badge number;
6        (5) Providing the victim with one referral to an
7    accessible service agency;
8        (6) Advising the victim of abuse about seeking medical
9    attention and preserving evidence (specifically including
10    photographs of injury or damage and damaged clothing or
11    other property); and
12        (7) Providing or arranging accessible transportation
13    for the victim of abuse (and, at the victim's request, any
14    minors or dependents in the victim's care) to a medical
15    facility for treatment of injuries or to a nearby place of
16    shelter or safety; or, after the close of court business
17    hours, providing or arranging for transportation for the
18    victim (and, at the victim's request, any minors or
19    dependents in the victim's care) to the nearest available
20    circuit judge or associate judge so the victim may file a
21    petition for an emergency order of protection under
22    subsection (c) of Section 217. When a victim of abuse
23    chooses to leave the scene of the offense, it shall be
24    presumed that it is in the best interests of any minors or
25    dependents in the victim's care to remain with the victim
26    or a person designated by the victim, rather than to

1    remain with the abusing party.
2    (b) Whenever a law enforcement officer does not exercise
3arrest powers or otherwise initiate criminal proceedings, the
4officer shall:
5        (1) Make a police report of the investigation of any
6    bona fide allegation of an incident of abuse, neglect, or
7    exploitation and the disposition of the investigation, in
8    accordance with subsection (a) of Section 303;
9        (2) Inform the victim of abuse neglect, or
10    exploitation of the victim's right to request that a
11    criminal proceeding be initiated where appropriate,
12    including specific times and places for meeting with the
13    State's Attorney's office, a warrant officer, or other
14    official in accordance with local procedure; and
15        (3) Advise the victim of the importance of seeking
16    medical attention and preserving evidence (specifically
17    including photographs of injury or damage and damaged
18    clothing or other property).
19    (c) Except as provided by Section 24-6 of the Criminal
20Code of 2012 or under a court order, any weapon seized under
21subsection (a)(2) shall be returned forthwith to the person
22from whom it was seized when it is no longer needed for
23evidentiary purposes.
24    (d) Beginning no later than July 1, 2031, a law
25enforcement officer investigating an alleged incident of
26intimate partner domestic violence shall administer a

1lethality assessment with the consent of the victim if:
2        (1) the allegation of intimate partner domestic
3    violence results in an arrest being made; or
4        (2) the allegation of intimate partner domestic
5    violence does not result in an arrest being made but an
6    allegation of an assault or a battery committed between
7    the intimate partners was made.
8    If the allegation of intimate partner domestic violence
9does not result in an arrest and no allegation of an assault or
10a battery committed between the intimate partners was made, a
11law enforcement agency is authorized to partner with a
12domestic violence center and the domestic violence center may
13administer a lethality assessment. The domestic violence
14center shall be provided with all available information
15necessary to conduct a lethality assessment as soon as
16possible. If a law enforcement agency chooses to partner with
17a domestic violence center to provide the lethality
18assessments, it must be documented in the agency's policy on
19lethality assessment as provided in this subsection.
20    Before the administration of a lethality assessment, a law
21enforcement officer must:
22        (1) inform the victim that the victim may decline
23    participation in the lethality assessment; and
24        (2) inform the victim of the ways in which the
25    information collected as part of the lethality assessment
26    may be used.

1    By July 1, 2027, the Department of Human Services shall
2develop, in consultation with the Illinois State Police, a
3statewide agency representing Illinois sheriffs, a statewide
4organization representing Illinois chiefs of police, a
5statewide organization representing State's Attorneys, and a
6statewide organization dedicated to domestic violence
7prevention, a model lethality assessment instrument and
8policies and protocols that local law enforcement agencies may
9use or reference in developing their own lethality assessment
10instrument and policies and protocols. Each law enforcement
11agency shall create a policy and a protocol on administering a
12lethality assessment consistent with the requirements of this
13Section, including how referrals to domestic violence services
14would be handled by the law enforcement agency. Each law
15enforcement agency that created a policy and protocol on
16administering a lethality assessment before the effective date
17of this amendatory Act of the 104th General Assembly may
18continue to use the policy and protocol if it is consistent
19with the requirements of this Section.
20    If a victim does not, or is unable to, provide information
21to a law enforcement officer sufficient to allow the law
22enforcement officer to administer a lethality assessment, the
23law enforcement officer must document the lack of a lethality
24assessment in the written police report and refer the victim
25to the nearest domestic violence center in accordance with
26paragraph (4) of subsection (a).

1    A law enforcement officer shall not include or attach in a
2probable cause statement, written police report, or incident
3report the domestic violence center to which a victim was
4referred; such information is exempt under Section 7.5 of the
5Freedom of Information Act.
6    Nothing in this subsection is intended to impose
7additional liability on a law enforcement officer or agency
8acting in good faith compliance with this subsection.

10    Section 95. No acceleration or delay. Where this Act makes
11changes in a statute that is represented in this Act by text
12that is not yet or no longer in effect (for example, a Section
13represented by multiple versions), the use of that text does
14not accelerate or delay the taking effect of (i) the changes
15made by this Act or (ii) provisions derived from any other
16Public Act.".
