SYNOPSIS AS INTRODUCED:

410 ILCS 35/16 new

Specifies that the amendatory Act may be referred to as Sami's Law. Amends the Equitable Restrooms Act. Provides that the owner or operator of each public building and State-owned building shall install and maintain in that building at least one adult changing station that is publicly accessible if the building is constructed 2 or more years after the effective date of the amendatory Act or if certain alterations or additions are made to the building 4 or more years after the effective date of the amendatory Act. Requires the owner or operator of a public building and the owner or operator of a State-owned building to ensure that certain information about the location of adult changing stations in the buildings is provided. Defines terms.

A BILL FOR

AN ACT concerning health.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. References to Act. This Act may be referred to as Sami's Law.

Section 5. The Equitable Restrooms Act is amended by adding Section 16 as follows:

(410 ILCS 35/16 new)

Sec. 16. Adult changing station.

(a) In this Section:

"Adult changing station" means a private, enclosed family or assisted-use toilet facility containing an adult changing table that is for use by individuals 13 years of age or older.

"Adult changing table" means a powered, height-adjustable table that:

(1) has safety rails on each side and a safety belt;

(2) is capable of being lowered to a height of 19 inches or less and raised to a height of at least 38 inches;

(3) is at least 25 inches wide and at least 72 inches long; and

(4) supports at least 400 pounds.

"Public building" means:

(1) a building or structure used for exhibition or entertainment, including, but not limited to, a movie theater, performance theater, concert hall, convention center, shopping mall, or a store that is larger than 40,000 square feet;

(2) a building or structure used for public display or collection, including, but not limited to, a museum, library, or gallery;

(3) a building or structure that is located in a place of recreation, including, but not limited to, a park, zoo, or amusement park; or

(4) any of the following located in this State:

(i) an airport;

(ii) a bus station;

(iii) an interstate rest stop;

(iv) a place of education;

(v) a hospital; or

(vi) a rehabilitation facility.

"State-owned building" means the State Capitol Building or a rest stop located on an interstate highway.

(b) The owner or operator of each public building and State-owned building shall install and maintain in that building at least one adult changing station that is accessible when the building is open to the public if:

(1) the building is constructed 2 or more years after the effective date of this amendatory Act of the 103rd General Assembly; or

(2) an alteration or addition is made to the building 4 or more years after the effective date of this amendatory Act of the 103rd General Assembly and that alteration or addition is valued at $50,000 or more and its construction requires the issuance of a building permit.

(c) The owner or operator of each public building and the owner or operator of each State-owned building shall ensure that:

(1) the entrance to each restroom in the building has conspicuous signage indicating the location of the adult changing stations in the building; and

(2) the central directory for the building, if such a directory exists, indicates the location of the adult changing stations in the building.
