AMENDMENT TO SENATE BILL 2226




2    AMENDMENT NO. ______. Amend Senate Bill 2226, AS AMENDED, 
3by replacing everything after the enacting clause with the 
4following:

 
 
5    "Section 5. The Department of Natural Resources 
6(Conservation) Law of the
Civil Administrative Code of 
7Illinois is amended  by adding Section 805-570 as follows:
 
8    (20 ILCS 805/805-570 new)
9    Sec. 805-570. Conservation Opportunity Areas.
10    (a)  In this Section, "Conservation Opportunity Area" means 
11a portion of this State within the Illinois Wildlife Action 
12Plan to assist with the conservation of native species and the 
13habitats that support them.
14    (b) Notwithstanding any other law to the contrary, a 
15Conservation Opportunity Area designation by the Department 
16shall not be used by the Illinois Power Agency beginning with

1the Long-Term Renewable Resources Procurement Plan outlined in 
2paragraph (5) of subsection (b) of Section 16-111.5 of the 
3Public Utilities Act developed in calendar year 2023 as a 
4basis to deny or withhold any:
5        (1) regulatory action;
6        (2) permitting;
7        (3) licensure; and
8        (4) funding.".
