AMENDMENT TO SENATE BILL 1289

AMENDMENT NO. ______. Amend Senate Bill 1289, AS AMENDED, with reference to page and line numbers of House Amendment No. 3, on page 3, line 7, after "easement", by inserting "or lease"; and

on page 3, line 13, by replacing "22.64" with "59.6"; and

on page 9, line 4, by replacing "Such" with "Additionally, such"; and

on page 9, line 9, after "incentives", by inserting ", such as signing bonuses,"; and

on page 31, line 4, after "Fire", by inserting "Service"; and

on page 31, line 21, by replacing "5.1017, and 5.1018" with "and 5.1017"; and

on page 32, by deleting line 5 through 7; and

by replacing line 21 on page 34 through line 8 on page 35 with the following:

"(d) For each carbon dioxide pipeline, the owner or operator of the pipeline shall use modeling that can handle non-flat terrain; obstacles, such as vegetation and buildings; time or spatial variations in wind, including direction and speed; ambient weather conditions, such as temperature and humidity; variations to the direction of release of CO₂; and concentrations and durations of CO₂, in addition to the specifics related to the pipeline design, including, but not limited to, diameter, thickness, and shutoff valves, to develop a risk-based assessment and a chemical safety contingency plan. The Illinois Emergency Management Agency and Office of Homeland Security shall publish this information on its website and provide these materials to local emergency management agencies in relevant counties."; and

on page 37 line 26, by deleting "and to sequester"; and

on page 40, lines 9 and 10, by deleting "and used to transport carbon dioxide"; and

on page 40, by replacing lines 18 and 19 with "does not include the sale or use of carbon dioxide for enhanced oil recovery in Illinois."; and

"(g) For the fiscal year beginning July 1, 2025, and each fiscal year thereafter, the Agency, in consultation with the Illinois Emergency Management Agency and the Office of Homeland Security, the Department of Natural Resources, and the Office of the Comptroller, shall transfer the following amounts collected under this Act by the Agency:

(1) 10% shall be retained in the Carbon Dioxide Sequestration Administrative Fund;

(2) 2% shall be transferred from the Carbon Dioxide Sequestration Administrative Fund to the Water Resources Fund;

(3) 6% shall be transferred from the Carbon Dioxide Sequestration Administrative Fund to the Oil and Gas Resource Management Fund;

(4) 20% shall be transferred from the Carbon Dioxide Sequestration Administrative Fund to the Emergency Planning and Training Fund;

(5) 28% shall be transferred from the Carbon Dioxide Sequestration Administrative Fund to the Carbon Dioxide Sequestration Long-Term Trust Fund;

(6) 10% shall be transferred from the Carbon Dioxide Sequestration Administrative Fund to the General Revenue Fund; and

(7) 24% shall be transferred from the Carbon Dioxide Sequestration Administrative Fund to the Environmental Justice Grant Fund.".
