| 1 | AN ACT concerning safety.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The PFAS Reduction Act is amended by adding | ||||||
| 5 | Section 40 as follows: | ||||||
| 6 | (415 ILCS 170/40 new) | ||||||
| 7 | Sec. 40. Guidance from United States Environmental | ||||||
| 8 | Protection Agency; PFAS monitoring plan; technical assistance; | ||||||
| 9 | PFAS disposal program. | ||||||
| 10 | (a) The Agency shall follow the most up-to-date guidance | ||||||
| 11 | to states from the United States Environmental Protection | ||||||
| 12 | Agency on addressing the discharge of PFAS in National | ||||||
| 13 | Pollutant Discharge Elimination System (NPDES) permits; | ||||||
| 14 | however, the Agency shall not require monitoring for PFAS in | ||||||
| 15 | influent, effluent, and biosolids to commence less than 30 | ||||||
| 16 | days after the United States Environmental Protection Agency | ||||||
| 17 | adopts an approved method for analyzing PFAS in these | ||||||
| 18 | matrices. Monitoring required under NPDES permits shall be | ||||||
| 19 | limited to those specific PFAS compounds for which an | ||||||
| 20 | analytical method has been approved by the United States | ||||||
| 21 | Environmental Protection Agency. | ||||||
| 22 | (b) The Agency shall create a PFAS monitoring plan. The | ||||||
| 23 | plan shall focus on the following: | ||||||

| 1 | (1) monitoring PFAS occurrence in wastewater flows | ||||||
| 2 | from industrial and domestic sources, stormwater | ||||||
| 3 | discharges, and solid waste streams; | ||||||
| 4 | (2) gathering State-specific information in order to | ||||||
| 5 | craft effective policies to address PFAS occurrence in | ||||||
| 6 | wastewater, stormwater, and solid waste; and | ||||||
| 7 | (3) gathering data to inform PFAS source reduction and | ||||||
| 8 | pollution prevention programs, including, but not limited | ||||||
| 9 | to, industrial pretreatment programs administered by | ||||||
| 10 | publicly owned treatment works. | ||||||
| 11 | The plan shall be submitted to the Governor and the | ||||||
| 12 | General Assembly by July 1, 2024. | ||||||
| 13 | (c) The Prairie Research Institute's Illinois Sustainable | ||||||
| 14 | Technology Center shall provide technical assistance to | ||||||
| 15 | industrial wastewater dischargers in best management | ||||||
| 16 | practices, pollution prevention, production substitution, and | ||||||
| 17 | elimination to reduce or eliminate PFAS compounds. | ||||||
| 18 | (d) The Agency shall establish
a take-back program for | ||||||
| 19 | fire departments that use and store firefighting foam
| ||||||
| 20 | containing PFAS. Fire departments that participated in the | ||||||
| 21 | most recent survey
described in Section 25 shall be eligible | ||||||
| 22 | to participate in
the program, but participation in the | ||||||
| 23 | program shall not be
required. The program shall provide | ||||||
| 24 | funding and resources to
ensure the proper destruction of | ||||||
| 25 | firefighting foam containing
PFAS. The program shall continue | ||||||
| 26 | for a period of 5 years or
until the Office of the State Fire | ||||||

| 1 | Marshal finds that no
firefighting foam containing PFAS is | ||||||
| 2 | reported in the survey
described in
Section 25. This program | ||||||
| 3 | is subject to appropriation. | ||||||
| 4 | (e) Implementation of this Section is subject to | ||||||
| 5 | appropriation.
| ||||||
| 6 | Section 99. Effective date. This Act takes effect upon | ||||||
| 7 | becoming law. | ||||||
