Amends various Acts relating to the governance of public universities and community colleges in Illinois. In provisions concerning notification of the status of classes, provides that each governing board must notify an adjunct professor and a nontenured-track faculty member about the status of enrollment of the class the person was hired to teach (instead of just an adjunct professor). Makes corresponding changes.

AN ACT concerning education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The University of Illinois Act is amended by changing Section 135 as follows:

(110 ILCS 305/135)

Sec. 135. Adjunct professor and nontenured-track faculty; status of class.

(a) At least 30 days before the beginning of a term and again at 14 days before the beginning of the term, the Board of Trustees must notify an adjunct professor or nontenured-track faculty member about the status of enrollment of the class the adjunct professor or nontenured-track faculty member was hired to teach.

(b) This Section does not apply if the Governor has declared a disaster due to a public health emergency or a natural disaster pursuant to Section 7 of the Illinois Emergency Management Agency Act.

(c) Collective bargaining agreements with adjunct professors that are in effect on January 1, 2022 (the effective date of Public Act 102-260) are exempt from the requirements of this Section. Collective bargaining agreements with nontenured-track faculty that are in effect on the effective date of this amendatory Act of the 103rd General Assembly are exempt from the requirements of this Section.

Section 10. The Southern Illinois University Management Act is amended by changing Section 115 as follows:

Sec. 115. Adjunct professor and nontenured-track faculty; status of class.

(a) At least 30 days before the beginning of a term and again at 14 days before the beginning of the term, the Board must notify an adjunct professor or nontenured-track faculty member about the status of enrollment of the class the adjunct professor or nontenured-track faculty member was hired to teach.

(b) This Section does not apply if the Governor has declared a disaster due to a public health emergency or a natural disaster pursuant to Section 7 of the Illinois Emergency Management Agency Act.

(c) Collective bargaining agreements with adjunct professors that are in effect on January 1, 2022 (the effective date of Public Act 102-260) are exempt from the requirements of this Section. Collective bargaining agreements with nontenured-track faculty that are in effect on the effective date of this amendatory Act of the 103rd General Assembly are exempt from the requirements of this Section.

Section 15. The Chicago State University Law is amended by changing Section 5-225 as follows:

Section 50. The Public Community College Act is amended by changing Section 3-29.16 as follows:

Sec. 3-29.16. Adjunct professor and nontenured-track faculty; status of class.

(a) At least 30 days before the beginning of a semester or term and again at 14 days before the beginning of the semester or term, a community college must notify an adjunct professor or nontenured-track faculty member about the status of class enrollment of the class the adjunct professor or nontenured-track faculty member was assigned to teach.

(b) This Section does not apply if the Governor has declared a disaster due to a public health emergency or a natural disaster pursuant to Section 7 of the Illinois Emergency Management Agency Act.

(c) Collective bargaining agreements with adjunct professors that are in effect on January 1, 2022 (the effective date of Public Act 102-260) are exempt from the requirements of this Section. Collective bargaining agreements with nontenured-track faculty that are in effect on the effective date of this amendatory Act of the 103rd General Assembly are exempt from the requirements of this Section.
