| 2 | | AMENDMENT NO. ______. Amend House Bill 3969 on page 1, by |
| 3 | | inserting after line 16 the following:

| 4 | | "Soft restraints may be used for transporting youth under |
| 5 | | the care or custody of the Department only in the following

| 6 | | limited circumstances: (i) if, based on a youth's mental health |
| 7 | | needs, a
psychiatrist orders the use of restraints for |
| 8 | | transporting a youth under the care or custody of the |
| 9 | | Department; or
(ii) if a court orders the use of restraints for |
| 10 | | transporting a youth under the care or custody of the |
| 11 | | Department.
Further, even in those 2 limited circumstances, the |
| 12 | | use of soft restraints is not permitted unless there is a |
| 13 | | written recommendation by the Department's Chief
Deputy |
| 14 | | Director, Clinical and Child Services and written approval by |
| 15 | | the Department's Chief Deputy Director.".
