| 1 | AMENDMENT TO HOUSE BILL 3263

| 2 | AMENDMENT NO. ______. Amend House Bill 3263 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 5. The Open Meetings Act is amended by adding | ||||||
| 5 | Section 7.4 as follows: | ||||||
| 6 | (5 ILCS 120/7.4 new) | ||||||
| 7 | Sec. 7.4. Required public posting of information by | ||||||
| 8 | participating municipalities and instrumentalities under the | ||||||
| 9 | Illinois Municipal Retirement Fund. A participating | ||||||
| 10 | municipality or instrumentality under Article 7 of the Illinois | ||||||
| 11 | Pension Code shall post on its publicly available website, if | ||||||
| 12 | the participating municipality or instrumentality maintains a | ||||||
| 13 | publicly available website: (1) all documents pertaining to the | ||||||
| 14 | municipality's or instrumentality's adoption of a resolution | ||||||
| 15 | to participate under Article 7 of the Illinois Pension Code if | ||||||
| 16 | the municipality or instrumentality has adopted such a | ||||||
| |||||||
| |||||||
| 1 | resolution; (2) all documents pertaining to the municipality's | ||||||
| 2 | or instrumentality's annual projected future contributions | ||||||
| 3 | under Article 7 of the Illinois Pension Code; and (3) | ||||||
| 4 | information about the amount of the municipality's or | ||||||
| 5 | instrumentality's past required contributions to the Illinois | ||||||
| 6 | Municipal Retirement Fund for each year of participation. This | ||||||
| 7 | Section does not require a participating municipality or | ||||||
| 8 | instrumentality to post on its website information that is | ||||||
| 9 | exempt from disclosure under the Freedom of Information Act. | ||||||
| 10 | Section 90. The State Mandates Act is amended by adding | ||||||
| 11 | Section 8.43 as follows: | ||||||
| 12 | (30 ILCS 805/8.43 new) | ||||||
| 13 | Sec. 8.43. Exempt mandate. Notwithstanding Sections 6 and 8 | ||||||
| 14 | of this Act, no reimbursement by the State is required for the | ||||||
| 15 | implementation of any mandate created by this amendatory Act of | ||||||
| 16 | the 101st General Assembly.
| ||||||
| 17 | Section 99. Effective date. This Act takes effect upon | ||||||
| 18 | becoming law.".
