AMENDMENT TO HOUSE BILL 3152

AMENDMENT NO. ______. Amend House Bill 3152 on page 15, by replacing lines 15 through 24 with the following:

"(b-15) Beginning in 2022, without obtaining any approvals from the Commission or any other agency, regardless of whether any such approval would otherwise be required, each participating utility shall pay the following amounts, as applicable, to the energy low-income and support program, which is intended to fund customer assistance programs with the primary purpose being avoidance of imminent disconnection and reconnecting customers who have been disconnected for nonpayment. A participating utility other than a combination utility shall pay $10,000,000 per year for 10 years, and a participating utility that is a combination utility shall pay $1,000,000 per year for 10 years. Such"; and

on page 19, by replacing lines 8 through 13 with "law. To enable the financing of the"; and

by deleting line 17 on page 27 through line 7 on page 28; and

on page 43, line 2, by deleting "this"; and

by replacing line 9 on page 46 through line 8 on page 47 with the following:

"(h) By December 31, 2017, the Commission shall prepare and file with the General Assembly a report on the infrastructure program and the performance-based formula rate. The report shall include the change in the average amount per kilowatthour paid by residential customers between June 1, 2011 and May 31, 2017. If the change in the total average rate paid exceeds 2.5% compounded annually, the Commission shall include in the report an analysis that shows the portion of the change due to the delivery services component and the portion of the change due to the supply component of the rate. The report shall include separate sections for each participating utility.

Sections 16-108.5, 16-108.6, 16-108.7, and 16-108.8 of this Act, other than this subsection (h), are inoperative after December 31, 2032 2022 for every participating utility, after which time a participating utility shall no longer be eligible to annually update the performance-based formula rate tariff pursuant to subsection (d) of this Section. At such time, the then current rates shall remain in effect until such time as new rates are set pursuant to Article IX of this Act, subject to retroactive adjustment, with interest, to reconcile rates charged with actual costs.

The fact that this Section becomes inoperative as set forth in this subsection shall not be construed to mean that the Commission may reexamine or otherwise reopen prudence or reasonableness determinations already made.".
