AMENDMENT TO HOUSE BILL 2461




2    AMENDMENT NO. ______. Amend House Bill 2461, with reference 
3to the page and line numbers of Senate Amendment No. 1, by 
4inserting the following immediately below line 16, on page 74:

"Article 5.

 
6    Section 5-5. The State Comptroller Act is amended  by adding 
7Section 28 as follows:
 
8    (15 ILCS 405/28 new)
9    Sec. 28. State Comptroller purchase of real property.
10    (a) Subject to the provisions of the Public Contract Fraud

11Act, the State Comptroller, on behalf of the State of Illinois, 
12is
authorized during State fiscal years 2021 and 2022 to 
13acquire
real property located in the City of Springfield, which 
14the State Comptroller deems necessary to properly carry out
the 
15powers and duties vested in him or her. Real property
acquired

1under this Section may be acquired subject to any
third party 
2interests in the property that do not prevent the
State 
3Comptroller from exercising the intended beneficial use of
such 
4property. This subsection (a) is inoperative on and after July 
51, 2022.
6    (b) Subject to the provisions of the Comptroller's

7Procurement Rules, which shall be substantially in accordance

8with the requirements of the Illinois Procurement Code, the

9State Comptroller may:
10        (1) enter into contracts relating to construction,

11    reconstruction, or renovation projects for any such

12    buildings or lands acquired under subsection (a); and
13        (2) equip, lease, repair, operate, and maintain those 
14    grounds,
buildings, and facilities as may be appropriate to 
15    carry out
his or her statutory purposes and duties.
16    (c) The State Comptroller may enter into agreements for the 
17purposes of exercising his or her authority under this Section.
18    (d) The exercise of the authority vested in the Comptroller 
19to acquire
property under this
Section is subject to 
20appropriation.
21    (e) The Capital Facility and Technology Modernization Fund 
22is hereby created as a special fund in the State treasury. 
23Subject to appropriation, moneys in the Fund shall be used by 
24the Comptroller for the purchase, reconstruction, lease, 
25repair, and maintenance of real property as may be acquired 
26under this Section, including for expenses related to the

1modernization and maintenance of information technology 
2systems and infrastructure. 
 
3    Section 10. The State Finance Act is amended  by adding 
4Section 5.935 as follows:
 
5    (30 ILCS 105/5.935 new)
6    Sec. 5.935. The Capital Facility and Technology 
7Modernization Fund.".
