| 1 | | AN ACT concerning regulation.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Illinois Insurance Code is amended by adding |
| 5 | | Section 352b as follows:
|
| 6 | | (215 ILCS 5/352b new) |
| 7 | | Sec. 352b. Policy of individual or group accident and |
| 8 | | health insurance. Unless specified otherwise and when used in |
| 9 | | context of accident and health insurance policy benefits, |
| 10 | | coverage, terms, or conditions required to be provided under |
| 11 | | this Article, "policy of individual or group accident and |
| 12 | | health insurance", as used in this Article, does not include |
| 13 | | any coverage or policy that provides an excepted benefit, as |
| 14 | | that term is defined in Section 2791(c) of the federal Public |
| 15 | | Health Service Act (42 U.S.C. 300gg-91). Nothing in this |
| 16 | | amendatory Act of the 101st General Assembly applies to a |
| 17 | | policy of liability, workers' compensation, automobile medical |
| 18 | | payment, or limited scope dental or vision benefits insurance |
| 19 | | issued under this Code.

| 21 | | Section 10. The Illinois Insurance Code is amended by |
| 22 | | repealing Section 356z.16.
