| 1 | AN ACT concerning education.
| ||||||||||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
| 3 | represented in the General Assembly:
| ||||||||||||||||||||||||||
| 4 | Section 5. The School Code is amended by adding Sections | ||||||||||||||||||||||||||
| 5 | 10-20.67 and 34-18.60 as follows: | ||||||||||||||||||||||||||
| 6 | (105 ILCS 5/10-20.67 new) | ||||||||||||||||||||||||||
| 7 | Sec. 10-20.67. Temporary door locking device. | ||||||||||||||||||||||||||
| 8 | (a) In this Section, "temporary door locking device" means | ||||||||||||||||||||||||||
| 9 | an assembly of parts intended for use by a trained school staff | ||||||||||||||||||||||||||
| 10 | member in a school building for the purpose of preventing both | ||||||||||||||||||||||||||
| 11 | ingress and egress through a door of the building. | ||||||||||||||||||||||||||
| 12 | (b) Upon submitting an application to the regional | ||||||||||||||||||||||||||
| 13 | superintendent of schools in a form and manner prescribed by | ||||||||||||||||||||||||||
| 14 | the regional superintendent, a school district may obtain a | ||||||||||||||||||||||||||
| 15 | temporary door locking device for use on a school building. The | ||||||||||||||||||||||||||
| 16 | application shall include, but is not limited to: | ||||||||||||||||||||||||||
| 17 | (1) evidence of a properly adopted and filed school | ||||||||||||||||||||||||||
| 18 | safety plan under the School Safety Drill Act; | ||||||||||||||||||||||||||
| 19 | (2) a statement confirming that law enforcement | ||||||||||||||||||||||||||
| 20 | officials and the local fire department have been notified | ||||||||||||||||||||||||||
| 21 | about the temporary door locking device; | ||||||||||||||||||||||||||
| 22 | (3) a description of the temporary door locking device | ||||||||||||||||||||||||||
| 23 | the school district proposes to acquire; and | ||||||||||||||||||||||||||

| 1 | (4) a statement confirming that any bolts, stops, | ||||||
| 2 | brackets, or pins employed by the temporary door locking | ||||||
| 3 | device do not affect the fire rating of a fire door | ||||||
| 4 | assembly. | ||||||
| 5 | Upon receiving an application under this subsection (b), a | ||||||
| 6 | regional superintendent shall evaluate the school district's | ||||||
| 7 | proposed temporary door locking device to ensure compliance | ||||||
| 8 | with subsection (c) of this Section. The regional | ||||||
| 9 | superintendent may consult a local fire department when | ||||||
| 10 | reviewing the application if the consultation would not result | ||||||
| 11 | in the undue delay of approving or disapproving the | ||||||
| 12 | application. | ||||||
| 13 | If a regional superintendent approves an application under | ||||||
| 14 | this subsection (b), the approval shall be noted on the school | ||||||
| 15 | building's certificate of occupancy. If a regional | ||||||
| 16 | superintendent disapproves an application, he or she shall | ||||||
| 17 | notify the school district of the decision and the reasons for | ||||||
| 18 | the decision. | ||||||
| 19 | (c) An approved temporary door locking device shall be used | ||||||
| 20 | only (i) by a staff member of a school district trained under | ||||||
| 21 | subsection (d) of this Section, (ii) during an emergency | ||||||
| 22 | situation that threatens the health and safety of students and | ||||||
| 23 | staff members or during an active shooter drill, and (iii) when | ||||||
| 24 | law enforcement officials and the local fire department have | ||||||
| 25 | been notified prior to use of the device. The device shall be | ||||||
| 26 | engaged for a finite period of time in accordance with the | ||||||
| |||||||

| 1 | school district's school safety plan adopted under the School | ||||||
| 2 | Safety Drill Act. The device may not be permanently mounted to | ||||||
| 3 | a door; however, assembly items such as bolts, stops, brackets, | ||||||
| 4 | or pins that do not prevent ingress and egress through the door | ||||||
| 5 | may be permanently mounted if they do not affect the fire | ||||||
| 6 | rating of a fire door assembly. After it is engaged, the | ||||||
| 7 | removal of the device must not require more than one operation; | ||||||
| 8 | however, 2 operations may be permitted when the school building | ||||||
| 9 | is equipped with an automatic sprinkler system. | ||||||
| 10 | (d) A school district with an approved temporary door | ||||||
| 11 | locking device shall conduct an in-service training program for | ||||||
| 12 | staff members on the proper use of the device. The school | ||||||
| 13 | district shall keep a file verifying the staff members who have | ||||||
| 14 | completed the program and shall provide the file to the local | ||||||
| 15 | fire department upon request. | ||||||
