AMENDMENT TO SENATE BILL 1337




2    AMENDMENT NO. ______. Amend Senate Bill 1337, AS AMENDED, 
3with reference to page and line numbers of Senate Amendment No. 
42, on page 6, line 16, before "fees", by inserting 
5"reasonable"; and
 


6on page 20, line 7, before "fees", by inserting "reasonable"; 
7and


 
8on page 22, immediately below line 22, by inserting the 
9following:


10    "(i-5) Before a county that establishes a stormwater 
11management planning council after submission of the question to 
12the electors of the county pursuant to subsection (a-5) may 
13submit a referendum question to the electors of the county for 
14an annual tax under subsection (i), the county shall:
15        (1) adopt and enforce a floodplain management 
16    ordinance under subsection (g) that has been approved by

1    the Office of Water Resources of the Department of Natural 
2    Resources; and

3        (2) designate a certified floodplain manager  who has 
4    been certified by the Association of State Floodplain 
5    Managers; however, nothing  in this paragraph (2) requires a 
6    county to create a new position or designate another 
7    individual if the county already has a certified floodplain 
8    manager on staff.
9    If a county fails to continually meet any of the conditions 
10of this subsection (i-5) after approval of a referendum 
11question for an annual tax, the county may not levy a tax under 
12subsection (i) until they are in full compliance with this 
13subsection (i-5)."; and
