| 2 | | Be it enacted by the People of the State of Illinois,

| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Student Optional Disclosure of Private |
| 5 | | Mental Health Act is amended by changing Section 5 as follows:

| 6 | | (110 ILCS 74/5)

| 7 | | Sec. 5. Definitions. In this Act: |
| 8 | | (a) "Designated person" means a parent, guardian, or other |
| 9 | | person over the age of 18 designated by the student to receive |
| 10 | | disclosure of certain private mental health information. |
| 11 | | (b) "Qualified examiner" has the meaning ascribed to that |
| 12 | | term in Section 1-122 of the Mental Health and Developmental |
| 13 | | Disabilities Code or means another person designated by an |
| 14 | | institution of higher learning.
