AMENDMENT TO HOUSE BILL 2662 




2    AMENDMENT NO. ______. Amend House Bill 2662 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The State Prompt Payment Act is amended  by 
5adding Section 3-5 as follows:
 
6    (30 ILCS 540/3-5 new)
7    Sec. 3-5. Contracts; appropriations.
8    (a) Notwithstanding any other provision of law to the 
9contrary, no new contracts shall be entered into by a State 
10agency without appropriation authority for the term of the 
11contract.
12    (b) This Section does not apply to:
13        (1) leases for real property;
14        (2) purchases of real estate;
15        (3) contracts subject to automatic renewal;
16        (4) collective bargaining agreements negotiated

1    pursuant to the Illinois Public Labor Relations Act or the 
2    Illinois Educational Labor Relations Act;
3        (5) multi-year contracts bid in accordance with the 
4    provisions of the Illinois Procurement Code; or
5        (6) contracts with telecommunications carriers or 
6    their affiliates.
7    (c) As used in this Section:
8    "State agency" has the meaning provided in Section 1-15.100 
9of the Illinois Procurement Code.
10    "Telecommunications carrier" has the meaning provided it 
11in Section 13-202 of the Public Utilities Act. 
 

12    Section 99. Effective date. This Act takes effect upon 
13becoming law.".
