Sec. 2310-745. Transfer of Coroner Training Board.

(a) The Coroner Training Board, as created by the Coroner Training Board Act, is hereby transferred to the Department. On and after July 1, 2025, the Department shall exercise the powers, duties, rights, and responsibilities provided under the Coroner Training Board Act and transferred to the Department under this amendatory Act of the 104th General Assembly.

(b) As soon as practicable after July 1, 2025, but not later than September 1, 2025, the personnel of the Coroner Training Board shall be transferred to the Department. The status and rights of those employees under the Personnel Code shall not be affected by the transfer. The rights of the employees and of the State of Illinois and its agencies under the Personnel Code or under any pension, retirement, or annuity plan shall not be affected by this amendatory Act of the 104th General Assembly.

(c) As soon as practicable after July 1, 2025, but not later than September 1, 2025, all books, records, papers, documents, property (real and personal), contracts, causes of action, and pending business pertaining to the powers, duties, rights, and responsibilities of the Coroner Training Board, including, but not limited to, material in electronic or magnetic format and necessary computer hardware and software, shall be transferred to the Department.

(d) Whenever reports or notices are now required to be made or given or papers or documents furnished or served by any person to or upon the Coroner Training Board, the same shall be made, given, furnished, or served in the same manner to or upon the Department.

(e) This amendatory Act of the 104th General Assembly does not affect any act done, ratified, or canceled or any right occurring or established or any action or proceeding had or commenced in an administrative, civil, or criminal cause by the Coroner Training Board before this amendatory Act of the 104th General Assembly takes effect; such actions or proceedings may be prosecuted and continued by the Department.

(f) Any rules of the Coroner Training Board that relate to its powers, duties, rights, and responsibilities and are in full force on July 1, 2025 shall become the rules and standards of the Department on July 1, 2025, and shall continue in effect until amended or repealed by the Department. This amendatory Act of the 104th General Assembly does not affect the legality of any such rules in the Illinois Administrative Code. Preexisting rules adopted by the Department prior to July 1, 2025 shall control in instances where the rules transferred from the Coroner Training Board overlap or are otherwise inconsistent.

Any rules filed with the Secretary of State by the Coroner Training Board that have been proposed but have not taken effect or have not been finally adopted by June 30, 2025, shall become proposed rules of the Department on July 1, 2025, and any rulemaking procedures that have already been completed by the Coroner Training Board for those proposed rules need not be repeated. On July 1, 2025, or as soon thereafter as practicable, the Department shall revise and clarify the rules transferred to it under this amendatory Act of the 104th General Assembly to reflect the reorganization of powers, duties, rights, and responsibilities affected by this amendatory Act, using the procedures for recodification of rules available under the Illinois Administrative Procedure Act, except that existing title, part, and section numbering for the affected rules may be retained.

(g) On July 1, 2025, or as soon thereafter as practicable, all unexpended appropriations and balances and other funds available for use by the Coroner Training Board shall be transferred for use by the Department. Unexpended balances so transferred shall be expended only for the purposes for which the appropriations were originally made.
