| 1 | AMENDMENT TO SENATE BILL 2356

| 2 | AMENDMENT NO. ______. Amend Senate Bill 2356 by replacing | ||||||
| 3 | everything after the enacting clause with the following:
| ||||||
| 4 | "Section 1. Short title. This Act may be cited as the | ||||||
| 5 | Research Dogs and Cats Adoption Act. | ||||||
| 6 | Section 5. Definitions. As used in this Act: | ||||||
| 7 | "Animal adoption organization" means any non-profit | ||||||
| 8 | organization authorized to conduct affairs in Illinois, | ||||||
| 9 | incorporated for the purpose of adopting animals in need and | ||||||
| 10 | finding permanent, adoptive homes for the animals, and licensed | ||||||
| 11 | as an animal shelter under the Animal Welfare Act. | ||||||
| 12 | "Public funds" means appropriated and non-appropriated | ||||||
| 13 | funding from the State or federal government. | ||||||
| 14 | "Research facility" means an institution of higher | ||||||
| 15 | education or corporation located in this State that utilizes | ||||||
| 16 | dogs or cats for scientific, educational, or research purposes | ||||||

| 1 | and receives public funds, State or federal, for those | ||||||
| 2 | purposes. | ||||||
| 3 | "Research facility adoption policy" means an adoption | ||||||
| 4 | policy for dogs and cats that details the specific steps that a | ||||||
| 5 | person can take to adopt a dog or cat that is no longer | ||||||
| 6 | necessary for scientific, educational, or research purposes | ||||||
| 7 | and that in the opinion of the dog's or cat's veterinarian is | ||||||
| 8 | suitable for adoption. The policy shall apply only to dogs or | ||||||
| 9 | cats owned by the research facility. | ||||||
| 10 | Section 10. Research dogs and cats adoption. | ||||||
| 11 | (a) A research facility that owns dogs or cats for | ||||||
| 12 | scientific, educational, or research purposes shall have a | ||||||
| 13 | research facility adoption policy. The research facility | ||||||
| 14 | adoption policy shall be made available on the research | ||||||
| 15 | facility's website. | ||||||
| 16 | (b) The research facility adoption policy shall require | ||||||
| 17 | that the dog's or cat's veterinarian approve the dog or cat for | ||||||
| 18 | adoption prior to any adoption under the policy. | ||||||
| 19 | (c) The research facility adoption policy shall include | ||||||
| 20 | provisions pursuant to which an animal adoption organization | ||||||
| 21 | may be eligible to adopt and may seek the adoption of dogs and | ||||||
| 22 | cats from the research facility. | ||||||
| 23 | (d) A research facility that provides dogs or cats to an | ||||||
| 24 | animal adoption organization pursuant to a research facility | ||||||
| 25 | adoption policy may enter into an agreement with the animal | ||||||

| 1 | adoption organization, including, but not limited to, a | ||||||
| 2 | confidentiality agreement, to protect the research facility | ||||||
| 3 | from liability. | ||||||
| 4 | (e) A research facility that provides dogs or cats to an | ||||||
| 5 | animal adoption organization pursuant to its research facility | ||||||
| 6 | adoption policy is immune from any civil liability resulting | ||||||
| 7 | from the research facility's actions as described under this | ||||||
| 8 | Section, except for willful or wanton misconduct.
| ||||||
| 9 | Section 99. Effective date. This Act takes effect upon | ||||||
| 10 | becoming law.".
