| 2 | | Department shall provide for a central clearing house for |
| 3 | | information concerning local government problems and various |
| 4 | | solutions to those problems and shall assist and aid local |
| 5 | | governments of the State in matters relating to budgets, |
| 6 | | fiscal procedures, and administration. In performing this |
| 7 | | responsibility the Department shall have the power and duty to |
| 8 | | do the following: |
| 9 | | (1) Maintain communication with all local governments |
| 10 | | and assist them, at their request, to improve their |
| 11 | | administrative procedures and to facilitate improved local |
| 12 | | government and development. |
| 13 | | (2) Assemble and disseminate information concerning |
| 14 | | State and federal programs, grants, gifts, and subsidies |
| 15 | | available to local governments and to provide counsel and |
| 16 | | technical services and other assistance in applying for |
| 17 | | those programs, grants, gifts, and subsidies. |
| 18 | | (3) Assist in coordinating activities by obtaining |
| 19 | | information, on forms provided by the Department or by |
| 20 | | receipt of proposals and applications, concerning State |
| 21 | | and federal assisted programs, grants, gifts, and |
| 22 | | subsidies applied for and received by all local |
| 23 | | governments. |
| 24 | | (4) Provide direct consultative services to local |
| 25 | | governments upon request and provide staff services to |
| 26 | | special commissions, the Governor, or the General Assembly |

| 6 | | of literacy), members of racial or ethnic minority groups, and |
| 7 | | individuals who primarily reside in a rural area. "Covered |
| 8 | | population" also includes incarcerated individuals (other than |
| 9 | | those incarcerated in a federal correctional facility), |
| 10 | | including all justice-impacted and system-impacted |
| 11 | | individuals. |
| 12 | | "Digital navigator program" means a program in which |
| 13 | | designated volunteers or staff of an organization offer |
| 14 | | technical assistance to support broadband adoption, digital |
| 15 | | skill building, and the use of devices. |
| 16 | | "Senior citizen home" means an Illinois-based residential |
| 17 | | facility for people who are over the age of 65. The term |
| 18 | | "senior citizen home" includes, but is not limited to, |
| 19 | | convalescent homes, long-term care facilities, assistive |
| 20 | | living facilities, and nursing homes. |
| 21 | | "Community technology centers" provide computer access and |
| 22 | | educational services using information technology. Community |
| 23 | | technology centers are diverse in the populations they serve |
| 24 | | and programs they offer, but similar in that they provide |
| 25 | | technology access to individuals, communities, and populations |
| 26 | | that typically would not otherwise have places to use computer |
|

| 1 | | and telecommunications technologies. |
| 2 | | "Department" means the Department of Commerce and Economic |
| 3 | | Opportunity. |
| 4 | | "National school lunch program" means a program |
| 5 | | administered by the U.S. Department of Agriculture and state |
| 6 | | agencies that provides free or reduced price lunches to |
| 7 | | economically disadvantaged children. A child whose family |
| 8 | | income is between 130% and 185% of applicable family size |
| 9 | | income levels contained in the nonfarm poverty guidelines |
| 10 | | prescribed by the Office of Management and Budget is eligible |
| 11 | | for a reduced price lunch. A child whose family income is 130% |
| 12 | | or less of applicable family size income levels contained in |
| 13 | | the nonfarm income poverty guidelines prescribed by the Office |
| 14 | | of Management and Budget is eligible for a free lunch. |
| 15 | | "Telecommunications services" provided by |
| 16 | | telecommunications carriers include all commercially available |
| 17 | | telecommunications services in addition to all reasonable |
| 18 | | charges that are incurred by taking such services, such as |
| 19 | | state and federal taxes. |
| 20 | | "Other special services" provided by telecommunications |
| 21 | | carriers include Internet access and installation and |
| 22 | | maintenance of internal connections in addition to all |
| 23 | | reasonable charges that are incurred by taking such services, |
| 24 | | such as state and federal taxes. |

| 2 | | Sec. 5-30. Community Technology Center Grant Program. |
| 3 | | (a) Subject to appropriation, the Department shall |
| 4 | | administer the Community Technology Center Grant Program under |
| 5 | | which the Department shall make grants in accordance with this |
| 6 | | Article for planning, establishment, administration, and |
| 7 | | expansion of Community Technology Centers and for assisting |
| 8 | | public hospitals, libraries, and park districts in eliminating |
| 9 | | the digital divide. The purposes of the grants shall include, |
| 10 | | but not be limited to, volunteer recruitment and management, |
| 11 | | training and instruction, infrastructure, and related goods |
| 12 | | and services, including case management, administration, |
| 13 | | personal information management, and outcome-tracking tools |
| 14 | | and software for the purposes of reporting to the Department |
| 15 | | and for enabling participation in digital government and |
| 16 | | consumer services programs, for Community Technology Centers |
| 17 | | and public hospitals, libraries, and park districts. No |
| 18 | | Community Technology Center may receive a grant of more than |
| 19 | | $75,000 under this Section in a particular fiscal year. |
| 20 | | (b) Public hospitals, libraries, park districts, and State |
| 21 | | educational agencies, local educational agencies, institutions |
| 22 | | of higher education, senior citizen homes, and other public |
| 23 | | and private nonprofit or for-profit agencies and organizations |
| 24 | | are eligible to receive grants under this Program, provided |
| 25 | | that a local educational agency or public or private |
| 26 | | educational agency or organization must, in order to be |
|

|
| 1 | | eligible to receive grants under this Program, provide |
| 2 | | computer access and educational services using information |
| 3 | | technology to the public at one or more of its educational |
| 4 | | buildings or facilities at least 12 hours each week. A group of |
| 5 | | eligible entities is also eligible to receive a grant if the |
| 6 | | group follows the procedures for group applications in 34 CFR |
| 7 | | 75.127-129 of the Education Department General Administrative |
| 8 | | Regulations. |
| 9 | | To be eligible to apply for a grant, a Community |
| 10 | | Technology Center must serve a covered population or a |
| 11 | | community in which not less than 40% of the students are |
| 12 | | eligible for a free or reduced price lunch under the national |
| 13 | | school lunch program or in which not less than 30% of the |
| 14 | | students are eligible for a free lunch under the national |
| 15 | | school lunch program; however, if funding is insufficient to |
| 16 | | approve all grant applications for a particular fiscal year, |
| 17 | | the Department may impose a higher minimum percentage |
| 18 | | threshold for that fiscal year. Determinations of communities |
| 19 | | and determinations of the percentage of students in a |
| 20 | | community who are eligible for a free or reduced price lunch |
| 21 | | under the national school lunch program shall be in accordance |
| 22 | | with rules adopted by the Department. |
| 23 | | Any entities that have received a Community Technology |
| 24 | | Center grant under the federal Community Technology Centers |
| 25 | | Program are also eligible to apply for grants under this |
| 26 | | Program. |

| 1 | | The Department shall provide assistance to Community |
| 2 | | Technology Centers in making those determinations for purposes |
| 3 | | of applying for grants. |
| 4 | | The Department shall encourage Community Technology |
| 5 | | Centers to participate in public and private computer hardware |
| 6 | | equipment recycling initiatives that provide computers at |
| 7 | | reduced or no cost to low-income families, including programs |
| 8 | | authorized by the State Property Control Act. On an annual |
| 9 | | basis, the Department must provide the Director of Central |
| 10 | | Management Services with a list of Community Technology |
| 11 | | Centers that have applied to the Department for funding as |
| 12 | | potential recipients of surplus State-owned computer hardware |
| 13 | | equipment under programs authorized by the State Property |
| 14 | | Control Act. |
| 15 | | (c) Grant applications shall be submitted to the |
| 16 | | Department on a schedule of one or more deadlines established |
| 17 | | by the Department by rule. |
| 18 | | (d) The Department shall adopt rules setting forth the |
| 19 | | required form and contents of grant applications. |

| 22 | | (g) Duties of the Digital Divide Elimination Working Group |
| 23 | | include all of the following: |
| 24 | | (1) Undertaking a thorough review of grant programs |
| 25 | | available through the federal government, local agencies, |

| 6 | | advance digital literacy and computer access that are |
| 7 | | available through the federal government, local agencies, |
| 8 | | telecommunications providers, and business and charitable |
| 9 | | entities and attempting to update available programs on a |
| 10 | | regular basis. |
| 11 | | (3) Presenting the information compiled from items (1) |
| 12 | | and (2) to the Department of Commerce and Economic |
| 13 | | Opportunity, which shall serve as a single point of |
| 14 | | contact for applying for funding for the Digital Divide |
| 15 | | Elimination Fund and for distributing information to the |
| 16 | | public regarding all programs designed to advance digital |
| 17 | | literacy and computer access. |

| 25 | | participate fully in an increasingly digital economy and |

| 2 | | that is affordable, reliable, and fully scalable; |

| 5 | | broadband equity outcomes; and |
| 6 | | (3) all Illinoisans are empowered to use and |
| 7 | | participate fully in an increasingly digital economy and |
| 8 | | society. |
| 9 | | Examples of digital inclusion strategies include, but are |
| 10 | | not limited to, establishing digital navigator programs, |
| 11 | | programs that provide digital literacy and digital skills |
| 12 | | training, computer refurbishment programs, and device |
| 13 | | distribution programs. |
| 14 | | Grants under this Section shall be distributed to public |
| 15 | | hospitals, libraries, park districts, State agencies, local |
| 16 | | agencies, institutions of higher education, senior citizens |
| 17 | | homes, and other public and private nonprofit agencies and |
| 18 | | organizations that serve one or more of the covered |
| 19 | | populations. |
| 20 | | Grant applications under this Section shall be submitted |
| 21 | | to the Department. |
| 22 | | The Department may adopt rules concerning grant |
| 23 | | applications under this Section. |

| 25 | | Sec. 5-45. Statewide Community Technology Center Network. |

| 2 | | not more than $100,000 in fiscal year 2001 to establish and |

| 5 | | (b) Subject to appropriation, the Department may expend |
| 6 | | not more than $100,000 in fiscal year 2006 and each fiscal year |
| 7 | | thereafter to establish and administer a Statewide Community |
| 8 | | Technology Center Network and public facing data source that |
| 9 | | serves as a digital hub for mapping, data collection, and |
| 10 | | program evaluation to assist in local and regional planning |
| 11 | | and revenue development and outreach under this Article. |

| 13 | | Section 25. The Music and Musicians Tax Credit and Jobs |
| 14 | | Act is amended by changing Section 50-45 as follows: |
| 15 | | (35 ILCS 19/50-45) |
| 16 | | Sec. 50-45. Qualified music program evaluation and |
| 17 | | reports. |
| 18 | | (a) (Blank). |
| 19 | | The Department may make a recommendation to extend, |
| 20 | | modify, or not extend the program based on the evaluation. |
| 21 | | (b) (Blank). At the end of each fiscal quarter, the |
| 22 | | Department shall submit to the General Assembly a report that |
| 23 | | includes, without limitation: |
| 24 | | (1) an assessment of the economic impact of the |

| 1 | | program, including the number of jobs created and |
| 2 | | retained, and whether the job positions are entry level, |
| 3 | | management, vendor, or production related; |

| 5 | | brought to Illinois, including the amount of spending and |
| 6 | | type of Illinois vendors hired in connection with a |
| 7 | | qualified music company; and |
| 8 | | (3) a determination of whether those receiving |
| 9 | | qualifying Illinois labor expenditure salaries or wages |
| 10 | | reflect the geographic, racial and ethnic, gender, and |
| 11 | | income level diversity of the State of Illinois. |
| 12 | | (c) At the end of each fiscal year, the Department shall |
| 13 | | submit to the General Assembly a report that includes, without |
| 14 | | limitation: |
| 15 | | (1) the identification of each vendor that provided |
| 16 | | goods or services that were included in a qualified music |
| 17 | | company's Illinois spending; |
| 18 | | (2) a statement of the amount paid to each identified |
| 19 | | vendor by the qualified music program and whether the |
| 20 | | vendor is a minority-owned or women-owned business as |
| 21 | | defined in Section 2 of the Business Enterprise for |
| 22 | | Minorities, Women, and Persons with Disabilities Act; and |
| 23 | | (3) a description of the steps taken by the Department |
| 24 | | to encourage qualified music companies to use vendors who |
| 25 | | are minority-owned or women-owned businesses. |

| 1 | | Section 27. The Illinois Public Aid Code is amended by |
| 2 | | changing Sections 4-2 and 6-2 as follows: |
| 3 | | (305 ILCS 5/4-2) (from Ch. 23, par. 4-2) |
| 4 | | Sec. 4-2. Amount of aid. |
| 5 | | (a) The amount and nature of financial aid shall be |
| 6 | | determined in accordance with the grant amounts, rules and |
| 7 | | regulations of the Illinois Department. Due regard shall be |
| 8 | | given to the self-sufficiency requirements of the family and |
| 9 | | to the income, money contributions and other support and |
| 10 | | resources available, from whatever source. However, the amount |
| 11 | | and nature of any financial aid is not affected by the payment |
| 12 | | of any grant under the "Senior Citizens and Persons with |
| 13 | | Disabilities Property Tax Relief Act" or any distributions or |
| 14 | | items of income described under subparagraph (X) of paragraph |
| 15 | | (2) of subsection (a) of Section 203 of the Illinois Income Tax |
| 16 | | Act. The aid shall be sufficient, when added to all other |
| 17 | | income, money contributions and support to provide the family |
| 18 | | with a grant in the amount established by Department |
| 19 | | regulation. |
| 20 | | (a-5) For the purposes of this subsection, TANF grant |
| 21 | | amounts shall consist of the following portions: |
| 22 | | (1) 75% shall be designated for the child or children |
| 23 | | of the assistance unit; and |
| 24 | | (2) 25% shall be designated for the adult member or |
|

| 1 | | members of the assistance unit. |
| 2 | | (b) The Illinois Department may conduct special projects, |
| 3 | | which may be known as Grant Diversion Projects, under which |
| 4 | | recipients of financial aid under this Article are placed in |
| 5 | | jobs and their grants are diverted to the employer who in turn |
| 6 | | makes payments to the recipients in the form of salary or other |
| 7 | | employment benefits. The Illinois Department shall by rule |
| 8 | | specify the terms and conditions of such Grant Diversion |
| 9 | | Projects. Such projects shall take into consideration and be |
| 10 | | coordinated with the programs administered under the Illinois |
| 11 | | Emergency Employment Development Act. |
| 12 | | (c) The amount and nature of the financial aid for a child |
| 13 | | requiring care outside his own home shall be determined in |
| 14 | | accordance with the rules and regulations of the Illinois |
| 15 | | Department, with due regard to the needs and requirements of |
| 16 | | the child in the foster home or institution in which he has |
| 17 | | been placed. |
| 18 | | (d) If the Department establishes grants for family units |
| 19 | | consisting exclusively of a pregnant woman with no dependent |
| 20 | | child or including her husband if living with her, the grant |
| 21 | | amount for such a unit shall be equal to the grant amount for |
| 22 | | an assistance unit consisting of one adult, or 2 persons if the |
| 23 | | husband is included. Other than as herein described, an unborn |
| 24 | | child shall not be counted in determining the size of an |
| 25 | | assistance unit or for calculating grants. |
| 26 | | Payments for basic maintenance requirements of a child or |
|

| 1 | | children and the relative with whom the child or children are |
| 2 | | living shall be prescribed, by rule, by the Illinois |
| 3 | | Department. |
| 4 | | Grants under this Article shall not be supplemented by |
| 5 | | General Assistance provided under Article VI. |
| 6 | | (e) Grants shall be paid to the parent or other person with |
| 7 | | whom the child or children are living, except for such amount |
| 8 | | as is paid in behalf of the child or his parent or other |
| 9 | | relative to other persons or agencies pursuant to this Code or |
| 10 | | the rules and regulations of the Illinois Department. |
| 11 | | (f) Subject to subsection (f-5), an assistance unit, |
| 12 | | receiving financial aid under this Article or temporarily |
| 13 | | ineligible to receive aid under this Article under a penalty |
| 14 | | imposed by the Illinois Department for failure to comply with |
| 15 | | the eligibility requirements or that voluntarily requests |
| 16 | | termination of financial assistance under this Article and |
| 17 | | becomes subsequently eligible for assistance within 9 months, |
| 18 | | shall not receive any increase in the amount of aid solely on |
| 19 | | account of the birth of a child; except that an increase is not |
| 20 | | prohibited when the birth is (i) of a child of a pregnant woman |
| 21 | | who became eligible for aid under this Article during the |
| 22 | | pregnancy, or (ii) of a child born within 10 months after the |
| 23 | | date of implementation of this subsection, or (iii) of a child |
| 24 | | conceived after a family became ineligible for assistance due |
| 25 | | to income or marriage and at least 3 months of ineligibility |
| 26 | | expired before any reapplication for assistance. This |

| 1 | | subsection does not, however, prevent a unit from receiving a |
| 2 | | general increase in the amount of aid that is provided to all |
| 3 | | recipients of aid under this Article. |
| 4 | | The Illinois Department is authorized to transfer funds, |
| 5 | | and shall use any budgetary savings attributable to not |
| 6 | | increasing the grants due to the births of additional |

| 8 | | training services for recipients of aid under this Article IV. |
| 9 | | The Illinois Department shall target, to the extent the |
| 10 | | supplemental funding allows, employment and training services |
| 11 | | to the families who do not receive a grant increase after the |
| 12 | | birth of a child. In addition, the Illinois Department shall |
| 13 | | provide, to the extent the supplemental funding allows, such |
| 14 | | families with up to 24 months of transitional child care |
| 15 | | pursuant to Illinois Department rules. All remaining |
| 16 | | supplemental funds shall be used for employment and training |
| 17 | | services or transitional child care support. |
| 18 | | In making the transfers authorized by this subsection, the |
| 19 | | Illinois Department shall first determine, pursuant to |
| 20 | | regulations adopted by the Illinois Department for this |
| 21 | | purpose, the amount of savings attributable to not increasing |
| 22 | | the grants due to the births of additional children. Transfers |
| 23 | | may be made from General Revenue Fund appropriations for |
| 24 | | distributive purposes authorized by Article IV of this Code |
| 25 | | only to General Revenue Fund appropriations for employability |
| 26 | | development services including operating and administrative |

| 1 | | costs and related distributive purposes under Article IXA of |
| 2 | | this Code. The Director, with the approval of the Governor, |
| 3 | | shall certify the amount and affected line item appropriations |
| 4 | | to the State Comptroller. |
| 5 | | Nothing in this subsection shall be construed to prohibit |
| 6 | | the Illinois Department from using funds under this Article IV |
| 7 | | to provide assistance in the form of vouchers that may be used |
| 8 | | to pay for goods and services deemed by the Illinois |
| 9 | | Department, by rule, as suitable for the care of the child such |
| 10 | | as diapers, clothing, school supplies, and cribs. |
| 11 | | (f-5) Subsection (f) shall not apply to affect the monthly |
| 12 | | assistance amount of any family as a result of the birth of a |
| 13 | | child on or after January 1, 2004. As resources permit after |
| 14 | | January 1, 2004, the Department may cease applying subsection |
| 15 | | (f) to limit assistance to families receiving assistance under |
| 16 | | this Article on January 1, 2004, with respect to children born |
| 17 | | prior to that date. In any event, subsection (f) shall be |
| 18 | | completely inoperative on and after July 1, 2007. |
| 19 | | (g) (Blank). |
| 20 | | (h) Notwithstanding any other provision of this Code, the |
| 21 | | Illinois Department is authorized to reduce payment levels |
| 22 | | used to determine cash grants under this Article after |
| 23 | | December 31 of any fiscal year if the Illinois Department |
| 24 | | determines that the caseload upon which the appropriations for |
| 25 | | the current fiscal year are based have increased by more than |
| 26 | | 5% and the appropriation is not sufficient to ensure that cash |

| 1 | | benefits under this Article do not exceed the amounts |
| 2 | | appropriated for those cash benefits. Reductions in payment |
| 3 | | levels may be accomplished by emergency rule under Section |
| 4 | | 5-45 of the Illinois Administrative Procedure Act, except that |
| 5 | | the limitation on the number of emergency rules that may be |
| 6 | | adopted in a 24-month period shall not apply and the |
| 7 | | provisions of Sections 5-115 and 5-125 of the Illinois |
| 8 | | Administrative Procedure Act shall not apply. Increases in |
| 9 | | payment levels shall be accomplished only in accordance with |
| 10 | | Section 5-40 of the Illinois Administrative Procedure Act. |
| 11 | | Before any rule to increase payment levels promulgated under |
| 12 | | this Section shall become effective, a joint resolution |
| 13 | | approving the rule must be adopted by a roll call vote by a |
| 14 | | majority of the members elected to each chamber of the General |
| 15 | | Assembly. |

| 25 | | standards, rules and regulations of the Illinois Department. |

| 1 | | However, the amount and nature of any financial aid is not |
| 2 | | affected by the payment of any grant under the Senior Citizens |
| 3 | | and Persons with Disabilities Property Tax Relief Act, any |
| 4 | | rebate authorized under Section 2201(a) of the Coronavirus |
| 5 | | Aid, Relief, and Economic Security Act (Public Law 116-136) or |
| 6 | | under any other federal economic stimulus program created in |
| 7 | | response to the COVID-19 emergency, or any distributions or |
| 8 | | items of income described under subparagraph (X) of paragraph |
| 9 | | (2) of subsection (a) of Section 203 of the Illinois Income Tax |
| 10 | | Act. Due regard shall be given to the requirements and the |
| 11 | | conditions existing in each case, and to the income, money |
| 12 | | contributions and other support and resources available, from |
| 13 | | whatever source. In local governmental units which do not |
| 14 | | receive State funds, the grant shall be sufficient when added |
| 15 | | to all other income, money contributions and support in excess |
| 16 | | of any excluded income or resources, to provide the person |
| 17 | | with a grant in the amount established for such a person by the |
| 18 | | local governmental unit based upon standards meeting basic |
| 19 | | maintenance requirements. In local governmental units which do |
| 20 | | receive State funds, the grant shall be sufficient when added |
| 21 | | to all other income, money contributions and support in excess |
| 22 | | of any excluded income or resources, to provide the person |
| 23 | | with a grant in the amount established for such a person by |
| 24 | | Department regulation based upon standards providing a |
| 25 | | livelihood compatible with health and well-being, as directed |
| 26 | | by Section 12-4.11 of this Code. |

| 1 | | The Illinois Department may conduct special projects, |
| 2 | | which may be known as Grant Diversion Projects, under which |
| 3 | | recipients of financial aid under this Article are placed in |
| 4 | | jobs and their grants are diverted to the employer who in turn |
| 5 | | makes payments to the recipients in the form of salary or other |
| 6 | | employment benefits. The Illinois Department shall by rule |
| 7 | | specify the terms and conditions of such Grant Diversion |
| 8 | | Projects. Such projects shall take into consideration and be |
| 9 | | coordinated with the programs administered under the Illinois |
| 10 | | Emergency Employment Development Act. |
| 11 | | The allowances provided under Article IX for recipients |
| 12 | | participating in the training and rehabilitation programs |
| 13 | | shall be in addition to such maximum payment. |
| 14 | | Payments may also be made to provide persons receiving |
| 15 | | basic maintenance support with necessary treatment, care and |
| 16 | | supplies required because of illness or disability or with |
| 17 | | acute medical treatment, care, and supplies. Payments for |
| 18 | | necessary or acute medical care under this paragraph may be |
| 19 | | made to or in behalf of the person. Obligations incurred for |
| 20 | | such services but not paid for at the time of a recipient's |
| 21 | | death may be paid, subject to the rules and regulations of the |
| 22 | | Illinois Department, after the death of the recipient. |

| 24 | | Section 30. The Good Samaritan Energy Plan Act is amended |
| 25 | | by changing Section 30 and by adding Section 95 as follows: |

| 2 | | Sec. 30. Distribution of moneys from Fund. Subject to |
| 3 | | appropriations made by the General Assembly, the Department |
| 4 | | may spend moneys from the Good Samaritan Energy Trust Fund for |
| 5 | | the purpose of providing assistance authorized under Section |
| 6 | | 25. The Department, with the advice and consent of the Low |
| 7 | | Income Energy Assistance Policy Advisory Council, shall |
| 8 | | establish priorities for the distribution of moneys from the |
| 9 | | Good Samaritan Energy Trust Fund to low-income consumers to |
| 10 | | enable them to pay gas or electric bill arrearages in order to |
| 11 | | have household gas or electric utility service connected. |
| 12 | | Low-income consumers who are unable to have their service |
| 13 | | connected even with a LIHEAP grant shall be given preference. |
| 14 | | Notwithstanding any other provision of law, on October 1, |
| 15 | | 2025, or as soon thereafter as practical, the State |
| 16 | | Comptroller shall direct and the State Treasurer shall |
| 17 | | transfer the remaining balance from the Good Samaritan Energy |
| 18 | | Trust Fund into the Supplemental Low-Income Energy Assistance |
| 19 | | Fund. Upon completion of the transfer, the Good Samaritan |
| 20 | | Energy Trust Fund is dissolved, any future deposits due to the |
| 21 | | Good Samaritan Energy Trust Fund pass to the Supplemental |
| 22 | | Low-Income Energy Assistance Fund, and any outstanding |
| 23 | | obligations or liabilities of the Good Samaritan Energy Trust |
| 24 | | Fund pass to the Supplemental Low-Income Energy Assistance |
| 25 | | Fund. The Department shall ensure that moneys donated for the |

| 8 | | Section 35. The Urban Community Conservation Act is |
| 9 | | amended by changing Section 4 as follows: |

| 12 | | exists a Department of Urban Renewal created pursuant to the |

| 15 | | municipality, after 30 days' notice, published in a newspaper |
| 16 | | of general circulation within the municipality, and public |
| 17 | | hearing, shall have the power to provide for the creation of a |
| 18 | | Conservation Board, to operate within the boundaries of such |
| 19 | | municipality, pursuant to the provisions of this Act. The |
| 20 | | presiding officer of any municipality in which a Conservation |
| 21 | | Board is established shall appoint, with the approval of the |
| 22 | | governing body and of the Department of Commerce and Economic |
| 23 | | Opportunity, five residents of the municipality to act as a |

| 1 | | Conservation Board, hereinafter referred to as "the Board." |
| 2 | | Members of the Board shall be citizens of broad civic |
| 3 | | interest, administrative experience and ability in the fields |
| 4 | | of finance, real estate, building, or related endeavors, not |
| 5 | | more than three of whom shall belong to the same political |
| 6 | | party. One such member shall be designated by the presiding |
| 7 | | officer as Commissioner and shall serve at the pleasure of the |
| 8 | | presiding officer. He shall administer the functions assigned |
| 9 | | by the Board, preside over its meetings, and carry out |
| 10 | | whatever other functions may be assigned to him by the |
| 11 | | governing body. The Commissioner shall devote his full-time |
| 12 | | attention to the duties of his office and shall receive no |
| 13 | | public funds by way of salary, compensation, or remuneration |
| 14 | | for services rendered, from any other governmental agency or |
| 15 | | public body during his tenure in office, other than the salary |
| 16 | | provided by the governing body, except as herein otherwise |
| 17 | | specifically provided. |
| 18 | | Four other members of the Board shall be appointed, to |
| 19 | | serve one, two, three and four year terms. After the |
| 20 | | expiration of the initial term of office each subsequent term |
| 21 | | shall be of four years' duration. A member shall hold office |
| 22 | | until his successor shall have been appointed and qualified. |
| 23 | | Members of the Board shall be eligible to succeed themselves. |
| 24 | | Members of the Board other than the Commissioner shall serve |
| 25 | | without pay, except as herein otherwise specifically provided |
| 26 | | and no member of the Board shall acquire any interest, direct |

| 1 | | or indirect, in any conservation project, or in any property |
| 2 | | included or planned to be included in any conservation |
| 3 | | project, nor shall any member have any interest in any |

| 5 | | project. Members may be dismissed by the Presiding Office of |
| 6 | | the Municipality for good cause shown. Such dismissal may be |
| 7 | | set aside by a two-thirds vote of the governing body. |
| 8 | | Notwithstanding anything to the contrary herein contained, the |
| 9 | | Commissioner, may, during all or any part of his term also |
| 10 | | serve as Chairman or member of a Redevelopment Commission |
| 11 | | created pursuant to "The Neighborhood Redevelopment |
| 12 | | Corporation Law" approved July 9, 1941, as amended, and shall |
| 13 | | be entitled to receive and retain any salary payable to him as |
| 14 | | Chairman or member of any such Redevelopment Commission. Three |
| 15 | | members of the Conservation Board shall constitute a quorum to |
| 16 | | transact business and no vacancy shall impair the right of the |
| 17 | | remaining members to exercise all the powers of the Board; and |
| 18 | | every act, order, rule, regulation or resolution of the |
| 19 | | Conservation Board approved by a majority of the members |
| 20 | | thereof at a regular or special meeting shall be deemed to be |
| 21 | | the act, order, rule, regulation or resolution of the |
| 22 | | Conservation Board. |
| 23 | | The Conservation Board shall designate Conservation Areas |
| 24 | | and |
| 25 | | (a) Approve all conservation plans developed for |
| 26 | | Conservation Areas in the manner prescribed herein; |

| 1 | | (b) Approve each use of eminent domain for the acquisition |
| 2 | | of real property for the purposes of this Act, provided that |
| 3 | | every property owner affected by condemnation proceedings |
| 4 | | shall have the opportunity to be heard by the Board before such |
| 5 | | proceedings may be approved; |
| 6 | | (c) Act as the agent of the Municipality in the |
| 7 | | acquisition, management, and disposition of property acquired |
| 8 | | pursuant to this Act as hereinafter provided; |
| 9 | | (d) Act as agent of the governing body, at the discretion |
| 10 | | of the governing body, in the enforcement and the |
| 11 | | administration of any ordinances relating to the conservation |
| 12 | | of urban residential areas and the prevention of slums enacted |
| 13 | | by the governing body pursuant to the laws of this State; |
| 14 | | (e) Report annually to the presiding officer of the |
| 15 | | municipality; |
| 16 | | (f) Shall, as agent for the Municipality upon approval by |
| 17 | | the governing body, have power to apply for and accept capital |
| 18 | | grants and loans from, and contract with, the United States of |
| 19 | | America, the Housing and Home Finance Agency, or any other |
| 20 | | Agency or instrumentality of the United States of America, for |
| 21 | | or in aid of any of the purposes of this Act, and to secure |
| 22 | | such loans by the issuance of debentures, notes, special |
| 23 | | certificates, or other evidences of indebtedness, to the |
| 24 | | United States of America; and |
| 25 | | (g) Exercise any and all other powers as shall be |
| 26 | | necessary to effectuate the purposes of this Act. |
