| 1 | | AMENDMENT TO SENATE BILL 2740

| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2740 on page 3, |
| 3 | | immediately below line 18, by inserting the following: |
| 4 | | "(e) An aggrieved unit owner, an aggrieved prospective |
| 5 | | unit owner, or the board of managers may commence a civil |
| 6 | | action in State court against a developer or declarant who |
| 7 | | fails to comply with its requirements under subsection (c). If |
| 8 | | the court finds that the developer or declarant failed to |
| 9 | | comply with these requirements, it may award declaratory |
| 10 | | relief, actual damages, punitive damages and, if appropriate, |
| 11 | | equitable relief. |
| 12 | | The condominium association shall not be held liable for |
| 13 | | the failure of the developer or declarant to comply with its |
| 14 | | requirements under subsection (c).". |
