| 1 | | AMENDMENT TO SENATE BILL 2122

| 2 | | AMENDMENT NO. ______. Amend Senate Bill 2122 on page 2, by |
| 3 | | replacing lines 14 through 19 with the following: |
| 4 | | "(c) The presumption of inadmissibility of a confession of |
| 5 | | a minor, who at the time of the commission of the offense was |
| 6 | | under 18 years of age, at a custodial interrogation at a police |
| 7 | | station or other place of detention, when such confession is |
| 8 | | procured through the knowing use of deception, may be overcome |
| 9 | | by a preponderance of the evidence that the confession was |
| 10 | | voluntarily given, based on the totality of the |
| 11 | | circumstances."; and
|
| 12 | | on page 4, by replacing lines 9 through 14 with the following:
