| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The School Code is amended by adding Section |
| 5 | | 2-3.182 as follows:
|

| 7 | | Sec. 2-3.182. School unused food sharing plan. School |
| 8 | | districts shall incorporate a food sharing plan for unused |
| 9 | | food into their local wellness policy under Section 2-3.139. |
| 10 | | The food sharing plan shall focus on needy students, with the |
| 11 | | plan being developed and supported jointly by the district's |
| 12 | | local health department. Participants in the child nutrition |
| 13 | | programs, the National School Lunch Program and National |
| 14 | | School Breakfast Program, the Child and Adult Care Food |
| 15 | | Program (CACFP), and the Summer Food Service Program (SFSP) |
| 16 | | shall adhere to the provisions of the Richard B. Russell |
| 17 | | National School Lunch Act, as well as accompanying guidance |
| 18 | | from the U.S. Department of Agriculture on the Food Donation |
| 19 | | Program, to ensure that any leftover food items are properly |
| 20 | | donated in order to combat potential food insecurity in their |
| 21 | | communities. For the purpose of this Section, "properly" means |
| 22 | | in accordance with all federal regulations and State and local |
| 23 | | health and sanitation codes.
