SYNOPSIS AS INTRODUCED:
 

 
New Act

     Creates the Water Heater Safety Valve Act. Provides that a  manufacturer or supplier of  a hot water heater for use in a residential home or facility must supply or attach  a temperature mixing valve or other safety valve to the hot water heater or tank that prevents water with a temperature above 130 degrees Fahrenheit from coming from any faucet or other source of water into direct contact with a person. Amends the Illinois Plumbing License Law to provide that a  person engaged in plumbing who installs a hot water heater for use in a residential home or facility must supply or attach  a temperature mixing valve or other safety valve to the hot water heater or tank that prevents water with a temperature above 130 degrees Fahrenheit from coming from any bathtub faucet, shower faucet, sink faucet, or any other source of water into direct contact with a person.

1    AN ACT concerning safety.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 1. Short title. This Act may be cited as the Water 
5Heater Safety Valve Act.
 
6    Section 5. Temperature mixing valve or safety valve. A 
7manufacturer or supplier of  a hot water heater for use in a 
8residential home or facility must supply or attach  a 
9temperature mixing valve or other safety valve to the hot water 
10heater or tank that prevents water with a temperature above 130 
11degrees Fahrenheit from coming from any bathtub faucet, shower 
12faucet, sink faucet, or any other source of water into direct 
13contact with a person.
 
14    Section 90. The Illinois Plumbing License Law is amended by 
15changing Section 40 as follows:

17    Sec. 40. 
All persons engaged in plumbing as defined in this 
18Act shall
comply with the minimum code of standards for 
19plumbing and the fixtures,
materials, design and installation 
20methods of plumbing systems published
by the Department and 
21filed with the Secretary of State as required by this Act.

1    All installations of equipment, fixtures, appliances or 
2piping which
are used or intended for use entirely for or as a 
3part of a water supply
system or sewage disposal system and 
4thereby can affect the public health
shall comply with the 
5provisions of the State Plumbing Code for design,
materials, 
6installation and maintenance.  The installation, repair, 
7maintenance,
alteration or extension of building sewers shall 
8be done in accordance
with the State Plumbing Code. Any person 
9engaged in any of such work
shall upon investigation and 
10determination of non-compliance with the provisions
of the 
11State Plumbing Code be subject to the penalties contained in 
12this
Act.  Such prosecution shall be the responsibility of the 
13State's Attorney
or other authority as authorized by this Act.

14    A person engaged in plumbing who installs a hot water 
15heater for use in a residential home or facility must supply or 
16attach  a temperature mixing valve or other safety valve to the 
17hot water heater or tank that prevents water with a temperature 
18above 130 degrees Fahrenheit from coming from any bathtub 
19faucet, shower faucet, sink faucet, or any other source of 
20water into direct contact with a person.
