PART 1501 DRYCLEANER ENVIRONMENTAL RESPONSE TRUST FUND PROGRAM
SECTION 1501.320 DEDUCTIBLE REQUIREMENTS


 

Section 1501.320  Deductible Requirements

 

The following deductibles must apply before any reimbursement from the Fund for eligible costs relating to a release may be made:

 

a)         Active Drycleaning Facility Deductible

 

1)         If, by January 1, 2008, an eligible claimant submitting a claim for an active drycleaning facility completed site investigation and submitted to the Council a complete remedial action plan for the site, then the eligible claimant is responsible for the first $5,000 of eligible investigation costs and for the first $10,000 of eligible remedial action costs incurred in connection with the release from the drycleaning facility and is only eligible for reimbursement for costs that exceed those amounts, subject to any other limitations of the DERT Fund Act.

 

2)         Any eligible claimant submitting any other claim for an active drycleaning facility is responsible for the first $5,000 of eligible investigation costs and for the first $15,000 of eligible remedial action costs incurred in connection with the release from the drycleaning facility, and is only eligible for reimbursement for costs that exceed those amounts, subject to any other limitations of the DERT Fund Act.

 

b)         Inactive Drycleaning Facility Deductible

 

1)         If, by January 1, 2008, an eligible claimant submitting a claim for an inactive drycleaning facility completed site investigation and submitted to the Council a complete remedial action plan for the site, then the claimant is responsible for the first $10,000 of eligible investigation costs and for the first $10,000 of eligible remedial action costs incurred in connection with the release from that drycleaning facility, and is only eligible for reimbursement for costs that exceed those amounts, subject to any other limitations of the DERT Fund Act.

 

2)         Any eligible claimant submitting any other claim for an inactive drycleaning facility is responsible for the first $15,000 of eligible investigation costs and for the first $15,000 of eligible remedial action costs incurred in connection with the release from the drycleaning facility, and is only eligible for reimbursement for costs that exceed those amounts, subject to any other limitations of the DERT Fund Act.
